THAT Development Variance Permit Application VP-12-03 to exempt a proposed 2-lot subdivision from the water distribution system requirement of Subdivision and Development Servicing Bylaw No. 704, Table C.2.2, Reference Section 6.04 not be approved.

Purpose:
To consider issuance of a Development Variance Permit to vary RDCO Subdivision and Development Servicing Bylaw No. 704, Schedule C.2, Section 2 - Type & Extent of Servicing, by exempting the proposed 2 lot subdivision in the RU3 zone from the required servicing identified in Table C.2.2.; Reference Section 6.04.
The Regional Board postponed the application at their meeting of October 22, 2012 until such time as staff compiles further technical information including whether the applicant's proposal will meet the intent of RDCO Subdivision & Development Servicing Bylaw No. 704 and discussion with the City of Kelowna for requirements of fire protection.
Subsequent to October 22, 2012, RDCO staff has reviewed this matter and consulted with the City of Kelowna. Detailed information as requested by the Board is contained in the attached Memorandum dated November 20,2012.

THAT Land Use Contract Amendment Bylaw LUCA-277-07 and Zoning Amendment Bylaw No. 871-200 application Z09/05 not be given first reading.
AND THAT the Regional Board not grant a six-month extension to the applicant in accord with Regional District Application Procedures Bylaw No. 944.

Purpose:
To discharge Land Use Contract No. 277 from the property and rezone to RU6 Small Holdings and RU3 Rural 3 in order to permit subdivision of the 3.42 ha parcel into two lots.

(VP-12-03) Central Okanagan East Electoral Area (Electoral Areas and Kelowna Fringe Area - Unweighted Vote) Withdrawn from the agenda at the request of the applicant

Bylaws: (First Reading)
8.7 i) Land Use Contract Amendment Bylaw No. 277-07 for T. & L. Bergman, T. Bergman and M. & R. Kay (owners/applicants) to discharge Land Use Contract No. 277 in its entirety from the property (All Directors - Unweighted Vote)

ii) Zoning Amendment Bylaw No. 871-200 for the above to zone the property to RU6 Small Holdings and RU3 Rural 3 located adjacent to Trepanier Road and Paradise Valley Road. (Z09/05) Central Okanagan West Electoral Area (Electoral Areas, West Kelowna Fringe Area and Peachland Fringe Area - Unweighted Vote)

Staff report dated November 20,2012 outlined the amendment to discharge Land Use Contract No. 277 from the property and rezone to RU6 Small Holdings and RU3 Rural 3 in order to permit subdivision of the 3.42 ha parcel into two lots. At the time of initial consideration, August 24, 2009, staff did not support the application in recognition of the need for a formal planning process an Official Community Plan (OCP) for the area and a fire protection study. The proposed zones do not meet the minimum lot size (4 ha minimum) as prescribed in the Rural Residential designation of the new OCP and any zoning changes must be consistent with the OCP.

Staff reviewed the mapping and proposed plan of subdivision. It was noted that the proposal:
• Is not in keeping with the OCP;
• Does not meet the Subdivision and Development Servicing Bylaw requirements for a community water system;
• The Ministry of Environment supports the requirement of a community water system as a condition for development;
• The Board at its Nov. 8, 2012 meeting directed that a study for a community water system not proceed for a period of three years based on the lack of public support of Trepanier residents;
• The area is not within the boundaries of an established local fire protection district.

Discussion:
-The current OCP was just recently adopted. The OCP states that amendments may be considered if one or more key services are in place.
- This application started in 2009 with four extensions granted as an OCP was underway for the area. The applicant has always been aware that there was no staff support for the application based on RDCO policy and provisions of the
Subdivision and Development Servicing Bylaw.
-Land Use Contract (LUC) #277 permitted the subdivision of existing lots in the late 1960's or early 1970's prior to the current Subdivision & Development Servicing Bylaw being approved in 1996.

There is no lot size stipulation in LUC--they are very general and vague. In the OCP, the minimum lot size is 4 ha.
-It was noted that many properties in this area likely have a well source, or a license to draw from Trepanier Creek. Staff noted that the MOE has said that Trepanier Creek is over allocated and that water will have to be proven.
-If a subdivision is approved, the applicant would require a variance for no community water source.
- If the Board approves a subdivision with only a well source for 5 acres or less, staff believes it would open a 'flood gate' of applications with no ability for a community water system and this would be in opposition to Regional District policies and bylaws.
As there is a negative recommendation before the Board the applicant was asked if they wish to address the Board.
Terry Bergman, Trepanier Road, addressed the Board.
- The property has power, road access, sewage disposal and water through a water license with the Province.
- How much water do you have and what is the source?
  o Water license in place on Trepanier Creek for 1,000 gallons per day.
  o If the property is subdivided, the new owner would have use of the license for 500 gallons per day.
- The applicant believes water is not an issue. Fire protection is an issue but can be looked at in various ways.
- The applicant noted that he has letters of support from a variety of property owners in the area: Cliff Stowell, Rusty Ensign, Doug Turner, and Trevor Dixon.
- OCP is to be flexible in changes and values. Conditions have changed. He believes some people want 2.5 acre sized lots to allow for more density in the area.

Further discussion ensued:
- The Subdivision & Development Servicing Bylaw 704 is updated annually with new requirements from IHA and the Ministry.
-This application is not an amendment to the OCP and 'flies in the face' of all elements of the OCP which included an extensive consultation process and common sense planning principles.
-Development in rural areas such as this can have a major impact on neighbouring municipalities ie: fire protection, water issues, and goes against the OCP which encourages development in urban areas.
- If there is an outcry of public concern the Board should hear it at the Public Hearing.
- Concern was expressed that should an application be approved this will not lead to increased fire protection. The costs are just too high and residents recently had the opportunity to confirm they were not interested.
- Staff noted that as there is no designation to support 1 or 2 ha lot sizes within the OCP, and as there is no application for an OCP amendment staff will be required to have discussion with the applicant and consider next steps.
-Staff did not recommend support for this application at the beginning nor do they support it now. Bringing forward a new land use designation will create an issue where others may apply for small sized lots in any rural area.
-There was consensus that consideration of a land use designation is to be applied only to the subject property.

EDGSON/GRAY
THAT staff be directed to develop a draft OCP amendment and report how the Board might move forward with a future land use designation for the subject property for T. & L. Bergman, T. Bergman and M. & R. Kay (owners/applicants);
AND FURTHER THAT the Regional Board grant a six-month extension, at no further cost to the applicant, for Land Use Contract Amendment Bylaw LUCA-277-07 and Zoning Amendment Bylaw No. 871-200 (application Z09/05).

A round table for Mayors

The four member municipalities of the Inter-Municipal Services Advisory Board - Kelowna, West Kelowna, Vernon and Penticton - are continuing their work on common municipal issues including transit governance, the Okanagan Basin Water Board and environmental permitting.

The board is made up of the four municipal mayors and chief administrative officers.

On Friday, April 20, Kelowna Mayor Walter Gray, Vernon Mayor Robert Sawatzky, West Kelowna Mayor Doug Findlater and Penticton Mayor Dan Ashton met to plan ahead for the rest of 2012.

“By continuing to work together, the four municipalities are able to address areas of mutual concern, which will be a benefit to all the citizens of the Okanagan Valley,” says Penticton Mayor Dan Ashton.

In the past, that has included agreement on a common Safe Premises bylaw to handle properties found to be cultivating illegal drugs, the launching a Bylaw Dispute Adjudication System and lobbying for continued support of the Combined Forces Special Enforcement Unit of the RCMP, dedicated to organized crime activity.

This time around, the group discussed partnership opportunities with BC Transit, which is considering implementing a three-person panel to work with municipalities on planning.

The Mayors agreed that larger centres would like to work in tandem with its provincial transit partner, making the panel available to assist smaller centres with planning.

The group also noted it is looking forward to the Okanagan Basin Water Board’s strategic planning session scheduled for early June, and would call on municipal peers at the coming Southern Interior Local Government Association (SILGA) convention in Revelstoke to offer the OBWB suggestions and recommendations for consideration during its planning process.

Penticton Mayor Dan Ashton also broached the topic of environmental permitting issues relating to the reconstruction of streamside infrastructure, such as dike systems.

The City of Penticton will take the lead on the matter, writing a letter to senior government to review the lengthy and often costly process required before municipalities are able to conduct needed repairs.

Mayors Gray, Sawatzky, Findlater and Ashton signed two joint letters at the meeting: one to Premier Christy Clark seeking funding support for private landowners for forest fire mitigation and the other to the Union of BC Municipalities seeking a change in how funds are allocated under the Gas Tax Agreement.

Ongoing concerns that impact all member municipalities were also discussed, including enforcement of lakeshore zoning regulations and the RCMP policing agreement.

Inter-Municipal Services Advisory Board meetings are held quarterly and alternate between municipalities. The four mayors represent more than 80 per cent of the Okanagan’s population.

SUBJECT: Text & Mapping Amendments to Zoning Bylaw No. 871, 2000
Zoning Amendment Bylaw No. 871-204 (Application Z09/09)
(Regional District of Central Okanagan - applicant)

RECOMMENDATION:
THAT should the Board grant further readings to Zoning Amendment Bylaw No. 871-204, application Z09/09, that consideration of fourth and final readings be withheld pending receipt of bylaw approval from the Ministry of Transportation and Infrastructure and the Ministry of Community and Rural Development.

PURPOSE:
This is a Development Services Department initiated text & mapping amendment to Zoning Bylaw No. 871, 2000. The proposed amendments are listed in attached Bylaw No. 871-204 and attached Schedules 'A' , 'C', '0', 'E', 'F', 'G', 'H', 'I', 'J', and 'K'.

POLICY:
An informal policy of the Development Services Department is to review Zoning Bylaw No. 871 on a yearly basis. This on-going review is to ensure that the zoning bylaw remains consistent with Board policy and direction, interpretation issues are corrected and development trends are reflected.

BACKGROUND:
Zoning Amendment Bylaw No. 871-204 received first reading on February 22,2010 and a Public Hearing was held on April 26, 2010 prior to the regular Board meeting.

PLANNING STAFF COMMENTS:
It is noted that two of the mapping amendments (Schedules 'A' & 'G') represent properties located within 800 metres of a Controlled Access Highway (Highway 97C Coquihalla Connector).

In accord with the Transportation Act, the Ministry of Transportation and Infrastructure is required to formally approve local government bylaws concerning property located within 800 metres of a Controlled Access Highway prior to adoption of the application. It is also noted that the Ministry has previously indicated that they wish to review and sign-off on all RDCO text amendments of Zoning Bylaw No. 871 after the Board has granted third reading.

Regional District Bylaw Approval Exemption Regulation No. 279/2003 of the Ministry of Community and Rural Development does not apply in this situation as the text and mapping amendments applies to more than 20 hectares of land. Therefore the Ministry's approval is also required prior to final readings.

Should the Board grant further readings to the amendment bylaw, Planning staff recommends that the above noted Ministry approvals be obtained prior to consideration of fourth and final readings.

REGIONAL DISTRICT OF CENTRAL OKANAGAN BYLAW NO. 871-204

A Bylaw to Amend Regional District of Central Okanagan Zoning Bylaw 871, 2000

WHEREAS the Regional Board of the Regional District of Central Okanagan is desirous of amending Zoning Bylaw No. 871, 2000 under the provisions of the Local Government Act.

NOW THEREFORE the Regional Board of the Regional District of Central Okanagan, in an open meeting enacts as follows:

1 This bylaw may be cited as Regional District of Central Okanagan Zoning Amendment Bylaw No. 871-204.

2 That the Regional District of Central Okanagan Zoning Bylaw No. 871, 2000 is hereby AMENDED by the following and forms a part of this bylaw:

2.1. Amending PART 1 Administration:

2.1.1. SECTION 1.1 - Application by ADDING "District of West Kelowna," after 'City ofKelowna,'

2.2. Amending PART 3 General Regulations:

2.2.1. SECTION 3.10 - Fencing and Retaining Walls
2.2.1.1. subsection 3 by DELETING "A zones" and REPLACING with "A1 zones"
2.2.1.2. subsection 10 by DELETING in its entirety and REPLACING with "1.2 metre high black vinyl chain link fence shall be provided and maintained adjacent to boundary of a parcel with CD, R, RU and R3 zones, which abut a P zone. At the discretion of the Regional District of Central Okanagan, in consultation with the Director of Parks Services, the fencing requirement for 1.2 metre high black vinyl chain link fencing may be replaced with an approved alternative fencing material (such as triple rail farm fencing and page wire fencing) or waived where the RDCO has determined the surrounding environment and P zone does not require restricting public access and/or wildlife corridors."
