56% of the petitioners whom voted for the proposed $17,500 plus cost of the Fintry water system have every right to cause homelessness to their neighbours ... that is just how totally screwed up the law is!!!  Why do you think people sell when water comes, do you think everyone can drive a new car payment around every month for 30 years?  Why buy when you can lease?  Do you think everyone is made of money?  The truth of the matter is that some person goes homeless so others can have the water they want!  Well there is at least one person going to be homeless at the Valley of the Sun, and we would like you to know about it.  Don't think that this person is selling to make money because that isn't the case at all, this person can't afford the $143 per month for 30 years it may cost, and can't even pay $50 per month ... VOS was the only subdivision a person could live so cheap, but not now, and people may have a hard time selling the cost of the water system now too.  Where can a person go so cheap and still live near their family?  May as well say, the neighbours can kick you off your own empty lot, make you homeless, and send you off to Spuzzum never to be heard from again so the people don't have to buy their own water system!  Too bad it wasn't the other way around and the people with wells already couldn't just kick the ones who want water to Spuzzum!  Wonder how the 56 % of the voters would feel if they didn't get their grant-in-aid, would they have still voted the water system in?  There is no guarantee you will be getting anymore grants, and there is no guarantee that you won't be paying $17,500 even though you did get a small grant of approx. $1,100.  You signed for $17,500 and the Regional District can do what they want, now that you let them!  You may not have water and you may not have a house yet either ... maybe you want someone to help you pay for your house too!

General Regulation

Whereas it is considered desirable and expedient that community planning be available throughout the Province of British Columbia to ensure orderly development;

And whereas, pursuant to the provisions of the Local Services Act, the Lieutenant Governor in Council may, upon the recommendation of the Minister of Municipal Affairs, establish any area of the Province not incorporated as a city, town, village or district municipality as a local area for the preparation of community plans by the application of Divisions (1) and (6) of Part XXI of the Municipal Act1and the regulation of land use, zoning, subdivision control and the construction of buildings or structures of any kind by the application of Divisions (2), (3), (4) and (5) of Part XXI of the Municipal Act1;

And whereas pursuant to the provisions of the Town Planning Act2, certain areas of the Province were established as regulated areas for the purpose of community planning;

And whereas under the provisions of the Local Services Act, certain areas of the Province were established as local areas for the purpose of community planning;

And whereas the said regulated areas and local areas should be included within the local area established by this order;

1 Pursuant to sections 2 (a) and (k) and 3 of the Local Services Act, all those lands lying within the territorial limits of the Province of British Columbia, save and except those portions thereof which lie within the corporate limits of a city, town, village or district municipality are established as a local area under the name of "Provincial Community Planning Local Area" for the following purposes:

(a) the preparation of community plans by the application of Divisions (1) and (6) of Part XXI of the Municipal Act1;

(b) the regulation of land use, zoning, subdivision control and construction of buildings or structures of any kind by the application of Divisions (2), (3), (4) and (5) of Part XXI of the Municipal Act1.

2 The Minister of Municipal Affairs may designate any area of the said Provincial Community Planning Local Area as a community planning area wherein regulations for community planning may be imposed and may extend, alter or dissolve such community planning areas and may merge two or more such community planning areas.

3 The regulations authorized to be imposed by the said minister in any such community planning area shall be deemed to be those authorized under Divisions (1) to (6), inclusive, of Part XXI of the Municipal Act1, and the minister may make specific regulations for each community planning area.

4-5 Spent.

6 The Zoning Board of Appeal of each of the said regulated areas or local areas is hereby dissolved and reconstituted the Zoning Board of Appeal of the corresponding community planning area established under this order, and the members of the said Zoning Board of Appeal shall continue in office until the expiry of the term of their respective appointments.

7 The Zoning Boards of Appeal of the said re-established community planning areas shall have the duties and powers of Zoning Boards of Appeal constituted pursuant to the provisions of Division (3) of Part XXI of the Municipal Act3.

Regional and Community Planning Letters Patent issued in 1969 (page 20)
Under the authority of Supplementary Letters Patent dated March 19, 1969 the Regional District was granted the function of regional and community planning. It is noted that Community Planning Area #1 and part of Community Planning Area #2 established under the Local Services Act were within the boundaries of the Regional District and that certain regulations applied to those areas. These areas encompassed the Lakeview Heights area, South Pandosy and Rutland community north to Pino Road, all of which were outside the boundary of the City of Kelowna. In October of 1969, the provincial government passed an order in council to apply the regulations which were in force and effect in those areas as if they were bylaws adopted by the Regional Board. These regulations related to land use within those areas.

In September of 1972, the Regional Board expanded the Community Planning Area #1 provincial regulations to all electoral areas of the Regional District. Land use regulations were therefore clearly in place covering all areas of the Regional District; however, more controls were on the horizon with the provincial government adopting the Agricultural Land Reserve legislation in 1973.

Division (3) of Community Planning Area No. 1 Regulations pertaining to subdivision repealed March 17, 1971 and replaced by Subdivision Regulations 262/70 of the Local Services Act.

Zoning Amendment Bylaw No. 66 adopted on September 6, 1972 in order to apply zoning regulations to the Electoral Areas of the Regional District.

[6] The Regional District was originally incorporated by Letters Patent on August 24, 1967 and is now incorporated under the provisions of the Municipal Act, R.S.B.C. 1996, c. 323. On November 30, 1969 the Regional District assumed responsibility for, among other things, community planning and building regulation from the Central Okanagan Regional Planning Board (the “Planning Board”) by Supplementary Letters Patent.

[7] The Department of Highways has at all material times been responsible for granting approval of the Subdivision.
