Audio of Regional District of Central Okanagan Chair Robert Hobson and West Kelowna (alias Westbank) Mayor Doug Findlater giving an oral history lesson at the Regional Board meeting, in regards to the local government in the old days (not RDCO but Lakeview 1953 and Westbank Irrigation Districts 1922).  It wasn't until 1967 that the Regional District of Central Okangan was created.

780(7) Subject to the letters patent, the bylaws and resolutions of boards that had jurisdiction before the amalgamation, alteration or division remain in force until they are amended or repealed by the board having jurisdiction following the amalgamation, alteration or division.

(8) Sections 31 [rights and liabilities not affected by revocation and reissue of letters patent] and 32 [existing licences preserved] apply in respect of regional districts referred to in this section.

• Letters Patent are issued incorporating the Westside District Municipality. Those Letters Patent come into force on December 6, 2007, except sections 3.0, 3.1, 3.2, and 3.3 which come into force on the date the Letters Patent are issued.

• Letters Patent are issued for the Regional District of Central Okanagan. Those Letters Patent come into force on December 6, 2007, except section 6.2 comes into force on the date the Letters Patent are issued.

• The Lakeview Irrigation District, incorporated by Letters Patent dated May 22, 1951 is dissolved, effective December 31, 2010. The Westbank Irrigation District, incorporated by Letters Patent dated June 14, 1922 is dissolved, effective December 31, 2010. All assets, rights, claims and obligations of the Lakeview Irrigation District and the Westbank Irrigation District are transferred to the Westside District Municipality.

You can search a web page for a key word, usually by clicking in the top menu on EDIT and then click FIND in the list, then typing in the word you are looking for.

Letters Patent are the basic rules, approved by the Provincial Government (Lieutenant Governor in Council or Cabinet), that incorporate the regional district and its electoral areas by name and defined boundaries. The Letters Patent also outline the voting units for the regional district, determining how many directors are appointed from member municipalities and how many votes the directors have when an issue discussed by the regional board calls for a weighted vote. The Letters Patent set out the political and administrative framework for the delivery of services with the regional district’s defined geographical boundary.

Regulation under section 523 (1) (a) of the Local Government Act with respect to
regulating persons, their premises and activities in order to promote the preservation of health of all inhabitants of the electoral areas, as an extended service.

Health protection authority
523 (1) Subject to the Public Health Act, a board may, by bylaw,

(a) regulate and prohibit for the purposes of maintaining, promoting or preserving public health or maintaining sanitary conditions, and

(b) undertake any other measures it considers necessary for those purposes.

(2) Section 9 [spheres of concurrent authority] of the Community Charter applies to a bylaw under subsection (1).

(3) As a further limit on subsection (1), a board must not fluoridate the water supply unless the bylaw has received the assent of the electors.

Governor in Council may, by the issue of letters patent, transfer from the regional district to the newly
incorporated municipality the jurisdiction for the services in respect of all or a specified part of the service
area, with provisions that the Lieutenant Governor in Council considers necessary or advisable:

5.0 Letters patent of the regional district, as amended, are hereby further amended at the description
of Electoral Area J by deleting the phrase ''to be known as the Westside Electoral Area" and
substituting the phrase "to be known as the Central Okanagan West Electoral Area".
5.1 Letters patent of the regional district issued by Order in Council No. 332, approved and ordered
on May 2, 2002, are hereby amended by deleting section 3, 4, 5, 6 and 9.
5.2 The regional district shall hold an election for director for Electoral Area J, Central Okanagan
West Electoral Area
, on November 17,2007.
5.3 The term of office for the director elected as described in section 6.2 of these letters patent shall
commence upon the date of the first meeting of the regional district board in December 2007, or
when the director takes office, whichever is later, and ends, according to the Local Government
Act following the 2008 general local election.

With  respect to that part of the regional district not within a city, district, town or village municipality, the regional district has all the powers of a district municipality under Part XVI of the "Municipal Act." except sections 589 and 590, and the provisions of the said Part, except sections 589 and 590, apply mutatis mutandis.

a) reservoirs and storage tanks of whatever kind or nature

b) water, pipe-lines for transportation of water

c) rafts, floats, docks, and other such devices which are anchored or secured

The Regional Board may establish, maintain, operate and regulate grounds for the disposal of garbage and wastes, or enter into a contract for the provision therefor, within the area for the regional district comprising of Electoral Areas B, C, D, E and F, and those parts of Electoral Areas G and I described as follows:

3. The amount requisitioned under section 784 of the Municipal Act from Electoral Areas B, C, D, E and F, and defined areas of Electoral Areas G and I for

SLP dated Jan. 27, 1970 granted RDCO the function of Division VII - Garbage Disposal with Electoral Areas B, C, D, E and F and defined portions of Electoral Areas G and I as participating member municipalities.
And WHEREAS at the time the new City of Kelowna was incorporated, the Regional Board requested that the remaining portions of Electoral Areas D and F be added to the defined portion of Electoral Area I and that by supplementary Letters Patent issued the 2nd day of May 1974, Division VII - Garbage Disposal was amended by striking out the letters "D" and "F" and adding the remaining portion of Electoral Area I:
And WHEREAS by SLP issued the 28th day of August, 1975 the defined boundaries of Electoral Area I were further amended to take in the Joe Rich area: Amended to include all of Electoral Area I.
The function of Noise Control with Electoral Areas A, G and H as participating member municipalities.
The net annual cost of any function granted pursuant to subsection (4a) shall not exceed the product of
two mills on the assessed values referred to in subsection (2) of section 782 with participating municipalities, and the net annual cost of all functions granted pursuant to subsection (4a) shall not exceed the product of three mills on such assessed values:
be further amended by striking out paragraph 1 and substituting
"1. The Regional Board may
establish, maintain, operate and regulate grounds for the disposal of garbage and wastes, or enter into a contract for the provision therefor, within the area of the regional district comprising of Electoral Areas A and I."
Apportioned and levied on improvements only on the basis of assessment which may be taxed in the current year for school purposes.
No By-law shall be adopted without the Ministers approval.
No debt other than temp current borrowing shall be incurred.
Sums of money to be borrowed shall be determined by the Inspector of Municipalities.

Regional District of Central Okanagan has requested that the function of Division XVI - Garbage Collection and Disposal be
amended to include all of Electoral Area G and to apportion the costs on the basis of assessment on improvements only:
Amend LP by striking out defined area of Electoral Area G and substitute with Electoral Area G and defined Electoral Area H.
3. The annual net cost attributable to this function shall be apportioned among the member municipalities on the basis of assessment of improvements only which may be taxed in the current year for school purposes.

The regional districts were incorporated in the mid 1960’s by the province through the issuance of legal documents called Letters Patent. Each Letters Patent contains the name of the regional district, describes its boundary and the boundary of its electoral areas, and provides a formula for weighting the director’s votes. The province can change the boundary of the regional district and its electoral areas by amending the Letters Patent and the Local Government Department facilitates these changes through a restructure process.

This function provided for the operation and maintenance of the Westbank Sanitary Landfill which served most of the communities on the Westside of Okanagan Lake, including I.R. #9 & #10, and a user fee arrangement at the Kelowna Sanitary Landfill for the electoral areas on the eastside of Okanagan Lake. The Westside Sanitary Landfill has a long history of operation within the Westbank community. Initially this operation consisted of a pit and burn procedure on the site where the Kinsmen ball fields are presently located. This pit and burn operation was managed by the Westbank Irrigation District and looked after by long term Westbank resident, Sid Saunders. Upon closure of the pit and burn procedure, the Regional District operated a landfill on the same site until such time as sufficient space became a problem. The District then entered into a lease with crown land to establish a full sanitary landfill operation on its present day site on Asquith Road.

Prior to the implementation of this function, the Lakeview Irrigation District also operated a pit and burn site on the location where Brookhaven Westside Care Home is situated today. This pit and burn operation was also closed when the Westside Sanitary Landfill was established.

A garbage dump later to become landfill was operated on a site north of Killiney Beach on the west side of Okanagan Lake to serve Fintry, Ewing’s Landing, Valley of the Sun, Killiney Beach and West Shore communities. That operation was managed by long term resident, Jules Harvath. The Regional District experienced a lot of bear problems at this location and eventually it was closed in favour of locating the transfer station closer to the centre of the communities, and operated by a community association. A transfer station was also located at Traders Cover to provide a disposal site for residents generally within the Traders Cove and Lake Okanagan Resort areas.

Letters patent of regional districts

777 (1) Letters patent incorporating a regional district must specify the following:

(a) the name and boundaries of the regional district;

(b) the municipalities and electoral areas that comprise the regional district;

(c) the boundaries of each electoral area in the regional district;

(d) the voting unit for the regional district, by specifying the number of persons used to calculate the number of votes referred to in section 783 (2);

(e) the last date for appointment of municipal directors to the first board;

(f) the time and manner of the first election of electoral area directors;

(g) the chief election officer and the voting places for the first election under paragraph (f);

(h) the date, time and place of the board's first meeting;

(i) the sums that may be borrowed to meet the current lawful expenditures of the regional district in the year of incorporation and, if considered necessary, for the next year;

(j) the dates that may be observed initially, and once only, in place of statutory dates.

(k) [Repealed 2000-7-89.]

(l) [Repealed 2008-42-62.]

(2) No part of an electoral area may be in a municipality.

(3) On the recommendation of the minister, the Lieutenant Governor in Council may, by letters patent, do one or more of the following:

(a) specify the divisor used to calculate the number of directors referred to in section 783 (5);

(b) change the name of a regional district;

(c) amend the voting unit referred to in subsection (1) (d);

(d) redefine the boundaries of an electoral area, establish a further electoral area or eliminate an existing electoral area.

Exemption — bylaw amending service area boundary

2 (1) An amendment to an establishing bylaw that changes the boundaries of a service area by one or both of the following is exempt from the requirement for the inspector's approval under section 802 (3) of the Act:

(a) adding parcels to the service area;

(b) removing parcels from the service area.

(2) An exemption under subsection (1) applies only if

(a) the owners of parcels to be added, parcels to be removed or both, as the case may be, submit a petition to the regional district to change the boundaries of the service area, and

(b) at least 2/3 of the participants consent to the amendment.

Zoning Bylaw #35 says Community Planning Areas 1 and 2 within the said Regional District have been given the status of subdivision bylaws adopted by the Regional District  by virtue of the Supplementary Letters Patent approved on October 27, 1969.  Repealed by Zoning Bylaw #35 Nov 5, 1970
