7.1 2012-2016 Financial Plan Amendment Bylaw No. 1314,2012, 1st, 2nd and 3rd readings and Adoption (All Directors - Weighted Vote)

Staff provided an overview to the Board on the budget amendments required for the 2012 Financial Plan, including:
- Trepanier Bench transfer from Community Works Fund Gas Tax Reserve
- Wastewater Treatment Plant - amendment covers HST which is not recoverable, and administrative costs, capital costs which was missed in the initial budget. Biosolids work moved forward. DCC costs less than anticipated.
-Killiney Community Hall - RDCO does not own the hall so cannot include capital costs - transfer to the contractor for capital (housekeeping)
- Regional Parks/Westside Parks - total projects not changed, funds moved to other projects - Board approval has previously been given to the projects

6.1 Quarterly Program Measures Report (Year-to-Date - September 30, 2012)
Staff report dated November 1, 2012 outlined the program measures report year to- date September 30, 2012. Staff highlighted the executive summary comments.

- Corporate Services
o Recruitment process for new CAO has begun

- Waste Reduction
o Launch of paper reduction program
o Commercial waste quantities reduced by 2.8%
o Curbside collection radio frequency identification system
  • 1331 non-compliant customers identified and contacted, only 52 reoffenders
o Recycling - market downturn, budget effect

- Environmental Services
o Falcon Ridge Water - exploratory drilling for a new well
o Trepanier Bench Water - fire effects - 110 risk evident
o Leak Detection program for Westshore Water resulted in 43% reduction, and at Killiney Beach 20% of m3 pumped
o RDCO lift stations/collector systems - all pumps being investigated for deterioration
o Killiney Beach Water - reduction to scope of upgrade
o Reduced clerical staff by 0.5 FTE

With the hiring of a purchasing manager, total quantifiable savings to date are $201,902, including risk reduction to RDCO, time savings for managers and staff and stronger contracts.
It was noted that the full report is in the Board's Reader file.

Discussion
-It was noted that West Kelowna is interested in receiving further information on the RFID program and staff will update Council in the future.
-West Kelowna will look at trunk lines in the near future. It's a low priority for them.
-School site acquisition - approved by the Province, developers will be required to pay a fee in the future.
-Information provided to Kelowna for review of boundary extension.
-What are the financial implications of reduced recycling and reduced income is there a way to offset costs? Staff is focusing on reduction programs (paper free program) paying less processing costs when it ends up in the recycling bins - it's the only thing that can be done to offset costs. Material is not being returned to the landfill. There is no shutdown for recyclables. The material that is recycled here is sent to relatively local markets (not China) plastics go to the Lower Mainland, paper to Washington. We can stockpile if required but there is no ability for reduced transportation costs as we use local markets. Where does the money go for electronics? The Electronics Stewardship of BC - they run the program, collecting, marketing, hauling, processing and they fund depot operations.

Staff report dated October 30, 2012 outlined general impacts to consider during the 2013-2017 Financial Plan discussions. Full reporting will be completed through the budgeting process beginning in February. General impacts for 2013 were highlighted as a heads-up for the budgeting process.

12.2 Meeting with the auditors
P. Macklem noted that the auditors have been requested to attend the October 11th Governance & Services Committee meeting. Board members were requested to submit questions regarding the 2011 financial statements to the
CAO in advance so the auditors can come prepared. It was agreed that it is 'best practice' to have an In Camera meeting with the auditors. The current Board policy is to annually have the Auditors meet with the HRI Audit Committee prior to the financial statements coming forward to the Board for approval.

10. COMMITTEE RECOMMENDATIONS

10.1 Audit/HR Committee Report re: BOO Dunwoody's 2011 Management Letter-Actuarial Review (All Directors - Unweighted Vote)

Staff report dated July 16, 2012 outlined that following Board direction at its June 14th meeting, the Audit/HR Committee met and discussed BOO Dunwoody's management letter regarding an actuarial review of sick pay obligations. At its' July 12th meeting, the Committee reviewed the auditors recommendation and are comfortable with the current sick payout estimates
and no management change is required. The Committee further recommended in future years that the auditors be requested to meet with the Audit/HR Committee to review the audited financial statements prior to the statements being submitted to the Regional Board.

Discussion ensued regarding whether the auditors, even after the 2011 financial statements have been approved by the Board, should be requested to address the Board directly. Staff noted that there were no other concerns in the management letter other than the sick leave.

FIELDING/BAKER
THAT the Regional Board not approve an actuarial review at this time based on the Audit/HR Committee's comfort level with the current estimates of the sick pay obligation of the RDCO;
AND FURTHER THAT the auditors be requested to meet annually with the Audit/HR Committee to review the audited financial statements prior to the statements being submitted to the Regional Board.

FINDLATER/EDGSON
THAT resolution #182/12 be POSTPONED and that the auditors be invited to attend a future Governance and Services Committee meeting to discuss the 2011 Audited Financial Statements;
AND FURTHER THAT BOO Dunwoody's management letter be circulated to the Board for their information.

$9 million payroll for Regional District

The following are highlights from the Regional District of Central Okanagan Board meeting held Monday, June 25, 2012.

Fiscal 2011 Financial Disclosure Schedules - The Regional Board has received the 2011 report outlining remuneration and expenses for elected officials and their alternates along with 21 staff whose remuneration was greater than $75,000. In 2011, the remuneration and benefits of all Regional District employees totalled just over $9.1-million up $249,386 (2.8%) from 2010. The report also outlines payments totalling over $29.3-million to 99 suppliers during 2011 for goods and services exceeding $25,000. A copy is available for viewing online at regionaldistrict.com and at the Finance and Administration Services in the Regional District office, 1450 KLO Road, Kelowna.

Joe Rich Rural Land Use Bylaw Update - The Regional Board has given second and third reading to proposed amendments to the Joe Rich Rural Land Use Bylaw No. 1195. The amendments are part of the annual review of the bylaw to ensure it remains consistent with Board policy and direction and that development trends are reflected. In addition, if adopted one amendment would allow applications for Secondary Suite designation, subject to certain regulations being met and approval by the Regional Board.

Agricultural Land Exclusion Referral - The Regional Board supports an application made by Tolko Industries Limited to the Agricultural Land Commission to remove a one hectare waterfront parcel from the Agricultural Land Reserve (ALR). The application was referred to the Regional Board for its consideration and comment. The property is located along Westside Road, next to Bear Creek Provincial Park and has been used since the late 50’s for various non-farm uses including log storage, sorting and boom yard activities. The proposal does not conflict with the Regional District Agricultural Plan and as the property has poor agricultural soil capability is consistent with the Agricultural Policy of the Rural Westside Official Community Plan.

May Building Statistics - During May, Development Services approved 17 building permits for a construction projects valued at $1,461,818 in the Central Okanagan East and Central Okanagan West Electoral Areas. That compares with 14 permits issued in May of 2011 for projects valued at $914,000. So far this year, 38 permits have been approved for construction projects valued at $3.3-million. During the first five months of last year, 63 construction projects received permits in the two electoral areas for a total value of just over $5-million.

We owe a vote of thanks to Mayor Janice Brown of Spallumcheen, and the other 85 B.C. mayors who met in Penticton recently to try and solve the growing problem of increased municipal responsibilities and costs in the face of reduced federal/provincial funding.

They should not judge themselves harshly for failing to find a solution. A billion-dollar global conference of the world’s greatest economists came to a similar impasse and for the same reason. We need to deal with the disease of a privately-controlled money system rather than be constantly enmeshed in the disease’s manifold symptoms. Once diagnosed the cure could be almost unbelievably simple and quick.

Our system of debt-money creation by the sale of government bonds and debentures to private money lenders at compounding interest rates is, at its very source, both fatally flawed and unconstitutional. It has caused our government debts to climb out of control and Canada will only recover its earlier greatness when our federal government returns to creating the nation’s money in a controlled and responsible way as it is indeed required to do under Section 91 of the Constitution Act. It did this at well under one per cent, employing the publicly owned Bank of Canada as originally intended, to help get us out of the Great Depression and to make possible the financing of the Second World War. It can and must do so again, and urgently, if we are to avoid the economic tsunami now threatening to overwhelm us.

The reason Ottawa has had to cut back on provincial transfers is because the gross federal debt has now reached an astronomical $920 billion and the cost of servicing that private debt in 2011, according to StatsCan, amounted to $60 billion, the equivalent of $160 million a day. The province of B.C. has reduced funding to municipalities because, since 1995, provincial debt has increased by 165 per cent, from $27 billion to $45 billion and in 2011 cost B.C. taxpayers $2 billion in interest and other bank charges.

The collective annual cost of debt servicing for the 160 members of the Union of B.C. Municipalities – arranged exclusively via the Municipal Finance Authority on behalf of a private banking consortium – is estimated at well in excess of half-a-billion dollars. In the 42 years since the MFA’s inception, Vernon’s taxpayers alone have paid them more than $120 million in interest, a huge drain that has denied our community a vast array of badly-needed public amenities and community services. Borrowing privately at compound interest to fund municipal infrastructure is insane.

It gets worse, but I believe I’ve covered the subject fully enough to expose the problem and offer a solution. Community Options Groups' goal is to encourage broad discussion at SILGA, UBCM and FCM.

We are convinced that a movement toward a sustainable economic future can now only be seeded at community level since provincial and federal party politics has proven so divisive, corrupted and embarrassingly dysfunctional.

Regional Hospital District Spending Bylaws

The Regional Board has adopted 13 bylaws authorizing spending totalling $1,311,400 for its 40% share of capital equipment and projects within the Central Okanagan Health Region. Among the projects for Kelowna General Hospital: expansion of the pediatric area; purchase of three ultra-sound machines and two anaesthetic units with monitors; and an infant abduction system along with renovations of the Cottonwoods Care Centre tub rooms. The Hospital District Board also approved the 2011 Audited Financial Statements for the Central Okanagan Regional Hospital District.

6. ADMINISTRATION & FINANCIAL SERVICES

6.1 Approval of 2011 Regional District of Central Okanagan Financial Statements (All Directors - Unweighted Vote)

The 2011 financial statements prepared and audited in accordance with PSAB Standards by BDO Dunwoody were presented for Board consideration. Staff report dated June 14, 2012 outlined what PSAB Standards are and the reporting model.

Discussion:
• On pages 3-4 of the draft, the auditor is not clearly identified (ie: logo). Staff noted that the final financial statements will not be released until the Board adopts them.
• Employee benefit account notes a $1 billiability in the municipal pension account - the question was raised whether there is a plan for the Municipal Pension Plan to close the gap and what is RDCO's portion of the liability?
Chair Hobson, as chair of the Municipal Pension Plan Investment Committee, noted that rates have risen based on their auditor review. The Pension Plan is discussing their options. A presentation to the Board could be arranged should the Board wish to hear further information.
• The third last page (page 4) refers to a management letter. Staff was asked to provide a copy to the Board. One recommendation was to hire an actuary to review the RDCO sick leave payout. It was suggested that the
Audit/HR Committee review the management letter for possible recommendations to the Board.

EDGSON/FINDLATER
THAT the Regional Board of the Regional District of Central Okanagan approve the draft 2011 Financial Statements.

THAT the BDO Dunwoody management letter be referred to the Audit/HR Committee for review and discussions on options and that the committee report back to the Regional Board with any recommendations.

4. FINANCE DEPARTMENT

4.1 2012 - 2016 Financial Plan Introduction

a) Review of changes following the March 8, 2012 Governance & Services Committee meeting

M. Rilkoff provided an overview of the budget changes including:
• Total operating budget of $58m for 2012 (44.04% is debt, including municipal MFA payments; 48.83% is operating expenses; 7.59% is transfers to capital and reserves).
• Capital budget for 2012 is approximately $22m
•  Transfer to capital and reserves is $4,587,593
• Changes to the mosquito control program were highlighted. The Board approved an enhanced mosquito control program. Central Okanagan West grant in aid increased to reflect the mosquito control program.
• WWTP, lift stations and collector system - updated flow data resulted
in a shift to WFN due to new development/growth.
• Regional District basic administration grant - transferred to capital to pay down short term debt relating to the roof project.
•  Adjusted parcel tax roll from SIR
•  Pending issues were highlighted: WFN may withdraw from transit service do have their own direct operating agreement; fringe area planning allocation yet to be determined; regional rescue service review effects on the budget; and building inspection current shortfall is $33,010 (staff reviewing possibility of contracting out this service with member municipalities).

b) Review of 2012 Tax Rates
The residential tax rates for a home assessed at $499,000 were reviewed (including the draft rates from the February 17, March 8 and March 30 final budget discussions)
City of Kelowna - $(2.74)
District of Peachland - $(4.65)
District of Lake Country - $(0.85)
District of West Kelowna - $(5.79)
Central Okanagan West Electoral Area - $(4.67)
Central Okanagan East Electoral Area - $14.88

4.2 Public Comment on 2012 - 2016 Financial Plan

Chair Hobson opened the floor to any members of the public who wished to comment on the 2012 - 2016 Financial Plan.

Marsali Maciver, Central Okanagan West Electoral Area - expressed concern regarding the increase in water rates and questioned why North Westside residents didn't have consultation before rates were increased. It was noted that the area director has addressed residents at various community meetings. Staff circulated information directly to each resident
informing them of the changes proposed. The Board has agreed to the 50% increase at this time. An open house will be held in the community on April 18th.

Dave Robertson, North Westside resident - would like a public meeting on the water rates being imposed, not just an open house. Do water rates go into the specific service or general revenue? The RDCO does not have a general revenue account. Revenue goes directly into the service and remains as an asset of that service. How is the money going to be spent?
Staff noted that the intent of the public information session is to go over the water improvement for future upgrades and asset capital 20-year renewal plans.

Staff noted that as a result of the Urban Systems report received in February letters were sent to residents to highlight the funding gap and long term concerns regarding each water system. Residents have had the opportunity to contact staff or the director with any concerns or questions.

Mr. Robertson stated that residents should have input on how money is spent on the fire departments and the community hall maintenance.

4.3 Regional District of Central Okanagan 2012 - 2016 Financial Plan Bylaw No. 1305, 1st, 2nd and 3rd readings and Adoption (All Directors - Weighted Vote)

In discussion, concern was raised by some directors regarding:

o How administration is calculated. In review of previous budget documents it was noted that there has been an increase to
administration (specific increases in Finance, HR, EDC, 911, WWTP). Staff note that administration is allocated to the services.
An in-depth analysis of administration overhead was done in 2011 and presented to the Board. The Board at that time adopted a new policy which affected the rates for various services. Overhead rates have gone down significantly since the incorporation of West Kelowna.

o Operational costs increased over the 5-year plan, the question was raised how committed is the Board to implement the proposed 5year plan?

o Why has there been an increase in the Joe Rich Hall administration costs? A decision was made by the Board that all community halls receive the same admin overhead. Overhead costs are specific to the service.

o The Board needs to ensure taxes are spent wisely and determine the level of service they wish to provide for each service. It was noted that service reviews are being done including dog control and the oversight committee for regional rescue.

o 911 service - with the expansion of the 911 service to the various regional district has there been economies of scale with the expanded service? The contract is managed by the RCMP and the Regional District must follow their schedule/staffing requirements.
In the past this has caused unforeseen cost increases. The RDCO is now entering into a contract with the RCMP to provide staffing which will mean more control of the service. It was suggested that staff provide further background information for the 911 service how it started, expansion of economies of scale, operation costs, service expansion.

o The Board will need to address the question whether the RDCO's current model is what we want going forward, These questions will be addressed over the next year as the Board begins to review services provided.

2. Finance & Administrative Services

2.1 Introduction of the 2012-2016 Financial Plan

Marilyn Rilkoff introduced the budgeting process including:
- This is a working document for the Board to provide direction to staff for next meeting.
- Reminding how regional districts vary from municipalities: ie: regional districts do not collect taxes directly; regional districts must keep all services separate and cannot combine or inter-mingle any funds, surpluses or deficits; regional districts are not permitted to have operating reserves.
- An overview of what the budget binder includes, ie: RDCO Strategic Plan, tax requisition rates, 2012 program plans and department initiatives, department budget summary.

Included in the 2012 budget:
o 3-5% increase in utility costs
o New administrative overhead policy applied
o Expense increases or decreases over 2011 levels are highlighted for the service

- 2012 residential tax rate (on a home assessed at $490,000) and requisitions for the partners were reviewed. The average decrease (__)/increase to a home was discussed:
o City of Kelowna $(3.87)
o District of Peachland $(6.12)
o District of Lake Country $(2.40)
o District of West Kelowna $(7.22)
o Central Okanagan West Electoral Area $3.20
o Central Okanagan East Electoral Area $23.46 (increase is due to a shift in assessment values)

2.3 2012 Budget Review

Marilyn Rilkoff began a review of the 2012 budget. The question was raised regarding FTE's (full-time equivalents) and whether the cost is applied to the department they report to or the service. FTE costs are allocated to individual services. If you participate in a service you pay a portion of FTE.

Environmental Services
- Mosquito Control - budget will change when Peachland, WFN and District of West Kelowna confirm whether they will participate in an expanded program. West Kelowna Council will discuss at their Feb. 28th meeting.
- Lakeshore Road Improvements - when does debt end? Residents asked for upgrades to their road. It is a 20 year debt.
- Effluent Service - should be self-sustaining. If rates are too high, problems will occur. Efficiencies realized--engineering works improved. Although looking good this year, rates will go up in future years. There is significant impact due to the
new admin overhead policy.
- Water system - new utility rate policy is being developed. Rates will be raised with increase to reserves.
- WWTP and lift stations and collector systems - new budget will be brought forward. Flows and cost sharing are changing--reduction to DWK, increase to WFN as their flows have increased. Shift is about 10%. The WWTP Sewer Committee met and was in favor of the proposed budget.
- Recycling Centre - service costs reduced. Challenged with revenue as market conditions fluctuate. In 2011 there was fairly high revenue for scrap metal. We are being conservative on the revenue side. Tax requisition is down and moving in the right direction.
- Landfill closure - staff continue to work with the Ministry of Environment on a revised slope plan. This is required as the facility was closed two years early so an alternative slope work needs to be undertaken. There has been no other change at the landfill other than mandatory monitoring.
ACTION: Staff to bring forward a report to the Board on the landfill closure plan when further information is available from the Ministry of Environment.
- Solid Waste Management and recycling program - RDCO shares the cost of this program with each partner on the basis of population. Upon reviewing the latest Canada Census Data, it was discovered that BC Stats used in the past included the IR# and they do not pay for that service. The population numbers have been adjusted accordingly. There will be shift in costs to the program as a result. Staff noted that they have statistically valid evidence of WFN resident's use of the recycling program. WFN runs their own programs for recycling but they use our depots. Approximately 35% of recycling goes to the depot.
-Can the program be expanded to include Styrofoam? There is a processing challenge with Styrofoam. The Province is looking at making producers responsible for all packaging materials.
- Revenue from sale of recyclables fluctuates. Depot and hazard waste is fixed costs. Admin fee increased with new policy (middle tier level). In next two to three years producers will become responsible for some recycling costs which will create a reduction in revenues. This information has just been published and will continue to be worked on.
- Concern was expressed whether the 2012 recycling program budget should be amended to reflect lower costs to the partners. Staff noted that the partners can choose to budget less if they wish but the RDCO budgets conservatively.
ACTION: Staff to present a review of the recycling programs to the Board and municipal
Councils in late spring and fall.
Staff to include in 5 year projections reduction of expenses and revenue in recycling due to changes proposed at the provincial level.
Regional Planning
-Tax requisition down slightly. Gas tax funds and FCM grant approval has been received for the update of Regional Growth Strategy. Confirmed the RDCO can bill quarterly for RGS grant funds which will provide better reconciliation.
-Clarify fringe area planning process. What will be the impact to budgets? The municipalities have been asked to respond to this issue and have not yet done so.
-Why is there an increase in staffing costs--casual and summer student? Summer student involved in OCP work (PIBC members receive reduction in course fees if student taken on).
Electoral Area Planning
-Fringe area planning costs and how they will be shared? The municipalities have been asked to respond to this issue and have not yet done so.
-There are sufficient funds in place for the South Slopes OCP as proposed by the Board.
Fire Protection
-20 year plans are being worked on for all fire departments. Joe Rich has a small tax base so have put reserves aside to prevent financing over long period of time and large tax increases. Also looking at four cisterns in the area and whether gas
taxes can be used.
-Staff noted that fire underwriters give guidance on when trucks should be purchased - normally ever 20 years. What impact would it have on capital budgets if purchases moved to 25 or 30 years?
-Is there a vehicle replacement policy for fire equipment? What is the guidance given by the fire underwriters? Maintenance costs do increase as vehicles get older so that does need to be taken into consideration when considering vehicle replacement.
ACTION: Going forward staff to develop a vehicle replacement policy.
ACTION: Staff to bring forward the budget impact for the Joe Rich Fire Department if the capital requirements for the department are moved from 20 years to 25 or 30 years.
Building Inspection
- Building Inspection function has always been funded by the building permits not through tax requisition
- The service is not sustainable. Staff has been looking at options to reduce the service.
ACTION: Immediately reduce inspections to three days per week and that staff be directed to provide a report to the Board on what the service level and costs would be to contract out building inspection, and alternatively to provide a reduced service through the Regional District.
Dog Control
-Increase to tax requisition due to cost of service review
-Staff noted that the service review will address revenues increases. With respect to boarding dogs - legal counsel has been asked to provide a consent order (indemnification, euthanize if dog is at large or attacks) where dogs can be released to the owner while waiting court trail.
-Service review - achieve what the Board asked it to do! Come out with a model for cost recovery and model for service delivery with objective to reduce tax requisitions. Community money is it being efficiently used on dogs - many organizations doing the same thing.
Regional Parks
-Decrease in administration overhead
-On track for making purchases for land acquisitions
-Mission Creek Playground report - project identified in 2011, but has been removed from 2012 budget. There is a grant that could be used in 2012. Net impact to consider proposed upgrade is a $150,000 allocation. $2.06 increase for an average home. The playground is highly used but the equipment is dated.
-Do comments come back from public they don't like the playground? No, other than it is dated. Is there a safety issue - risk management issue? No. This is more around aging infrastructure. This is a phased approach--staff would like to
see more in the area, which would be at a higher cost.
-Should be part of a longer plan on upgrading recreation facilities. A plan is in place and has been identified in the five year plan.
-Are there any other projects that could be modified to reflect a phased approach to the Mission Creek playground. No.
-Is it possible to get more partnership money from community groups as well?
Staff will continue to look at those options.

Information Services
-GIS services - District of West Kelowna withdrew from the GIS service at the end of 2011. The cost of the service has increased to the other participants. At the direction of the Board, Kelowna and West Kelowna have been approached to
determine if there is interest in a different model for GIS services. To date there has been no response from either municipality.
-Finance staff also covers IT services in the Finance Department to ensure data protection and reduce consulting costs. This is a unique skill set available from staff (Finance and IT knowledge).
Electoral Area
- Increase to budget - requirement for ortho photos and transfer for set up of an electoral area feasibility study. DWK is planning to do ortho photos this year but it was too expensive for the RDCO to participate in for this year.
Westside Transit services
- WFN and Peachland costs down slightly. WFN and Peachland are looking at obtaining their own operating agreements with BC Transit.
Ellison Transit Service
- Can we increase the service or do away with it? It's of little value the way the service is currently being provided.
HANSON/EDGSON
THAT staff be directed to contact BC Transit to provide options for increased service to the Ellison transit service.
CARRIED
Sterile Insect Release
- Arrange for an annual presentation to the Board.
911
- RDCO share increased. Increased staffing cost for supervision.
- Looking at other method of service delivery
Crime Stoppers
- It was noted there is the potential a vehicle will need to be purchased. The current vehicle is donated and if arrangements cannot be made for a donation in the future a vehicle will need to be purchased.
The vehicle is a key awareness tool for the program and is used to transport equipment for their various functions. A vehicle is required.
-The question was raised what else the reserves would be used for? Nothing as far as capital needs.
OPHUS/FINDALTER
THAT the $30,000 for replacement of a vehicle be removed from capital budget, and if required in the future bring forward as a budget amendment.
DEFEATED (Ophus, Findlater, Edgson voted in favor)
Economic Development Commission
- No changes to the budget
- District of West Kelowna noted that they will be looking in the next year or two to pull out of the program as they are reviewing their own staff position. May contract for some services back to EDC.
Regional grant in aid
- Director Fielding asked for a reduction in Peachland's allocation to the Arts Council to $500 in total.
Starling Control
-This is the last year of the five year program approved by the three regional districts for Starling control in the valley.
ACTION: Request a Board presentation on the Starling Control Program in the fall if there are plans to continue with the program.

M. Rilkoff provided a wrap-up to the budget deliberations noting:
o Compliance with PSAB 3150
o Continuing to build asset data base
o WWTP study complete
o Master trunk plan in progress
o Utility rate study for water systems completed
o Working with fire departments on 20-year capital plans to determine reserve levels for the future.
o Continuing to review reserve balances and future capital needs.

Director Baker left at 12:18 p.m.

The action items from the meeting were highlighted.

It was noted that governments are being challenged to reduce taxes while still providing services to the public. Like other governments, the Regional District needs to continue to review whether there is duplication of service and if so, what can be done to provide services more effectively and efficiently.

SUBJECT: Committee Structure

The Chair requested that staff review the Regional District's committee structure in order to determine the feasibility of reducing the number of committees to streamline processes and decision making, in order to reduce costs. After reviewing all committees, it is recommended that the Governance and Services Committee recommend to the Regional Board that the committees, for the year 2012, be amended as follows:

HR/ Committee - no longer required, it's terms of reference are now included in the HR/Audit Committee (Chair and Mayors)

Sustainability Committee - this committee is comprised of the Mayors and Chair and meets infrequently. This committee can be eliminated and should issues arise they could be referred to the HR/Audit Committee.

Treaty Advisory Committee - can be eliminated for now and reinstated should treaty negotiations commence.

Watercraft Committee - This committee is community members at large, the mayors, and one other Board member. This committee has met once in the last four years and can be eliminated.

Agricultural Advisory Commission - Comprised of 6 members from the public and one Ministry appointment. Planning staff have found their input to be of value when dealing with ALR applications and OCP development and amendments and wish to see this committee continue. Costs are minimal as one staff attends and meetings are infrequent.

Environmental Advisory Commission - Currently 16 members appointed from the public. Staff has found this committee to provide valuable advice, at minimal cost (staff time for agenda prep and minutes), however the number of members could
be reduced to 9. Our recommendation would be to reduce to 9 by not reappointing any member until we reach less than 9.

Central Okanagan West Advisory Planning Commission - The Director from this Electoral Area wishes to keep this committee as he relies upon it when reviewing applications.

Central Okanagan East Advisory Planning Commission - The Director from this Electoral Area does not wish to continue with this committee and should be eliminated.

Dog Advisory Commission - That this committee be held in abeyance at this time and no appointments be made. This committee will be reviewed by the consultant as part of the Dog Control service review, and recommendations will be forthcoming as to it's structure, if needed.

Westside Wastewater Treatment Plant Stakeholder Committee - this is comprised of one representative each of West Kelowna, Peachland, Westbank First Nation, and the Regional District. This committee meets only when needed and has been effective and it is recommended that the committee continue.

In addition to the above noted Regional District Committees the Regional District appoints a Director to external committees. Our recommendation relating to these appointments are:

Airport Advisory Committee - continue to appoint the Chair as a representative.

Highway 97 Coalition - Not sure if this committee is continuing so no appointment is necessary at this time.

Okanagan Airshed Coalition - no longer exists, staff will continue to liaison with the South Okanagan Similkameen RD on joint initiatives, the North Okanagan RD no longer participates in air quality programs.

Okanagan Marine Advisory Council - this committee no longer meets.

There will be some savings in reducing the number of committees and meetings. Directors are reimbursed $65 for half day meetings and $130 for full day meetings, plus staff time required for preparation and attendance. It is difficult to quantify the dollar amount, as it is dependent on the number of meetings held.

This is submitted for the Committee's consideration.

10.1 RDCO Committee Structure Review

In follow-up to direction from the Regional Board, staff was asked to review the Regional District's committee structure in order to determine the feasibility of reducing committees no longer required and to potentially streamline the process
of decision making.

Staff report dated January 31, 2012 outlined recommendations for the following committees: HR Committee; Sustainability Committee; Treaty Advisory Committee; Watercraft Committee; Agricultural Advisory Commission; Environmental Advisory
Commission; Central Okanagan West Advisory Planning Commission; Central Okanagan East Advisory Planning Commission; Dog Advisory Committee; Westside Wastewater Treatment Plant Stakeholder Committee; Airport Advisory Committee; Highway 97 Coalition; Okanagan Airshed Coalition and the Okanagan Marine Advisory Council

Staff noted that due to concerns raised by the Environmental Advisory Commission which is largely made up of technical people, that by cutting back on its size the effectiveness of the Commission would be jeopardized. It was agreed that further
input should be received from the Commission prior to making a final decision on the number of members required.

ZIMMERMANN/EDGSON
THAT the Governance and Services Committee recommends to the Regional Board that the committee structure for the year 2012 be amended as follows:
• HR Committee - no longer required
• Sustainability Committee - no longer required
• Treaty Advisory Committee appointments - eliminate until treaty negotiations commence

Regional District of Central Okanagan Audit Committee

TERMS OF REFERENCE

INTRODUCTION

The Audit Committee was formed to review and critique the annual financial statements and operating results of the Regional District before they are approved by the Regional Board. The Audit Committee reinforces the principle that the administrative function of the Regional District is accountable to the legislative arm of the Regional District, and in turn the legislative arm is accountable to the taxpayers of the Region.

The Committee will provide this oversight, and also coordinate the Administrator's annual review and executive search in the event of a vacancy. The Committee will provide oversight of the collective bargaining process and human resource issues of Management and exempt staff.

The Audit Committee is a Standing Committee of Regional Board under the Board's Procedures Bylaw No. 1278.

OBJECTIVE
The objective of the Committee is to make recommendations to Regional Board on the:
• Audit function of the Regional District;
• Human resource issues related to Collective Agreement bargaining, management and exempt staff policy line, and the Regional District Administrator's annual review and recruitment; and
• any other matter which may impact on the efficiency and effectiveness of Regional District operations, or that will significantly impact Regional District assets.

8.3 RDCO Audit Committee -Terms of Reference & Appointments (All Directors - Unweighted Vote)

Chair Hobson presented the draft Terms of Reference for a new standing committee-the Audit Committee. The objectives, scope of work and membership were highlighted and the Board, although not required to according to the RDCO procedure bylaw, was asked by the Chair for agreement. One of the first orders of business will be to coordinate the executive search process for the Chief Administrative Officer position.

As this committee encompasses the work of the previous HR Committee it was suggested that the title be changed to Audit/HR Committee. There was consensus for this change. The question was raised whether alternates are required for the committee should a member not be available to attend a meeting. The committee can address this issue at their meeting.

FIELDING/STACK
THAT the Terms of Reference and appointments to the Audit/HR Committee be approved.

The following external appointments are required to be made at the December 12th Board meeting:

  • Okanagan Basin Water Board - 3 Directors and 3 Alternates (Director Keith Fielding from Peachland, ??)
  • Sterile Insect Release Board - 2 Directors and 1 Alternate
  • Okanagan Film Commission Board - 1 Director and 1 Alternate (Director Andre Blanleil from City of Kelowna, with Director Duane Ophus from West Kelowna as alternate)
  • Okanagan Regional Library - 1 Electoral Area Director and 1 Electoral Area Alternate (COW Director Jim Edgson and Director Patty Hanson from COE as alternate)
  • Economic Development Commission Advisory Board - 1 Electoral Area Director and 1 Electoral Area Alternate (Director Colin Basran from City of Kelowna and Director Duane Ophus from West Kelowna as alternate)
  • Southern Interior Beetle Action Committee - 1 Director and 1 Alternate (Director Jim Edgson from Central Okanagan West and Director Patty Hanson from Central Okanagan East as the alternate)
  • Municipal Finance Authority - 1 Director and 1 Alternate (Chair Robert Hobson elected himself mentioning that Director Duane Ophus from West Kelowna wanted the appointment )
  • Community Action Towards Children's Health (CATCH) - 1 Director and 1 Alternate (Director Keith Fielding from Peachland and Director Gail Given from City of Kelowna is the alternate)

A recommended list of appointees will be brought forward on December 12th.

The Governance and Services Committee functions as a 'committee-of-the-whole' comprised of all Regional Board members.

In addition, the Regional Board will review the remaining committees and their structure in the New Year at which time further appointments will be confirmed. These committees include:

Human Resources Committee;
Regional Sustainability Steering Committee;
Negotiating Committee;
Watercraft Committee;
Airport Advisory Committee;
Highway 97 Steering Committee;
Okanagan-Similkameen Airshed Coalition;
Okanagan Marine Advisory Council;
Dog Advisory Committee;
Weed Control Committee;
Westside Wastewater Treatment Service
Stakeholder Select Committee;
Agricultural Advisory Commission;
Environmental Advisory Commission;
Central Okanagan West Electoral Area Advisory Planning Commission and
Central Okanagan East Electoral Area Advisory Planning Commission.

5. NEW BUSINESS

5.1 Regional Board Appointments (All Directors - Unweighted Vote)
The following appointments are required to be made at this time as many of the Boards and Committees begin their meetings in January.

Governance and Services Committee; Court of Revision, Economic Development Commission, Emergency Operations Control Group, Okanagan Basin Water board, Okanagan Film Commission, Okanagan Regional Library, Sterile Insect Release, Community Action Towards Children's Health (CATCH), Municipal Finance Authority, and Southern Interior Beetle Action
Coalition (SIBAC).

A list of appointments was circulated.

The question was raised what the process will be for reviewing the remaining committees and commissions. The Chair noted this will be discussed at strategic priority session in January.
