About the Order in Council and Ministerial Order Resumes

The Resumes are reports of the decisions of the Lieutenant Governor in Council and Ministers. The Resumes are issued for informational purposes only.

Orders in Council are official documents implementing Government decisions concerned with the day-to-day operation of the Province.

The Resumes include the Order in Council identifying number; the originating Ministry; the name of the Act which provides the authority for the Order; and a resume of the subject matter.

From time to time, Orders are made by a Minister that do not require the approval of the Lieutenant Governor in Council.

These Orders will be included in the Resumes under a separate heading entitled “Ministerial Orders.”


A format similiar to Orders in Council will be followed indicating the number, date, ministry responsible, statutory authority and a brief resume of the subject matter.

Letters patent of regional districts

777 (1) Letters patent incorporating a regional district must specify the following:

(a) the name and boundaries of the regional district;

(b) the municipalities and electoral areas that comprise the regional district;

(c) the boundaries of each electoral area in the regional district;

(d) the voting unit for the regional district, by specifying the number of persons used to calculate the number of votes referred to in section 783 (2);

(e) the last date for appointment of municipal directors to the first board;

(f) the time and manner of the first election of electoral area directors;

(g) the chief election officer and the voting places for the first election under paragraph (f);

(h) the date, time and place of the board's first meeting;

(i) the sums that may be borrowed to meet the current lawful expenditures of the regional district in the year of incorporation and, if considered necessary, for the next year;

(j) the dates that may be observed initially, and once only, in place of statutory dates.

(k) [Repealed 2000-7-89.]

(l) [Repealed 2008-42-62.]

(2) No part of an electoral area may be in a municipality.

(3) On the recommendation of the minister, the Lieutenant Governor in Council may, by letters patent, do one or more of the following:

(a) specify the divisor used to calculate the number of directors referred to in section 783 (5);

(b) change the name of a regional district;

(c) amend the voting unit referred to in subsection (1) (d);

(d) redefine the boundaries of an electoral area, establish a further electoral area or eliminate an existing electoral area.

Historical Review of the Regional District of Central Okanagan

Regional and Community Planning Letters Patent issued in 1969
Under the authority of Supplementary Letters Patent dated March 19, 1969 the Regional District was granted the function of regional and community planning. It is noted that Community Planning Area #1 and part of Community Planning Area #2 established under the Local Services Act were within the boundaries of the Regional District and that certain regulations applied to those areas. These areas encompassed the Lakeview Heights area, South Pandosy and Rutland community north to Pino Road, all of which were outside the boundary of the City of Kelowna. In October of 1969, the provincial government passed an order in council (could be OIC 3409?) to apply the regulations which were in force and effect in those areas as if they were bylaws adopted by the Regional Board. These regulations related to land use within those areas. (page 20 or 23)

  • Initial regulations pertaining to the management of land use and subdivision established for Community Planning Area No. 1 under Supplementary Letters Patent, approved by the Provincial Government on October 27, 1969. (page 25)

Building Inspection
With the issuance of letters patent by the provincial government to enact and establish building regulations throughout the electoral areas, which were previously carried out under provincial jurisdiction, provincial building inspectors, Edward Ashton and Allan Cushing, transferred and became Regional District employees. In April 1971, the Regional Board enacted and established building regulations pursuant to its authority granted by the Province. Subject to several amendments so as to make it more applicable to the Central Okanagan and to improve standards, the regulation adopted by the Regional District encompassed most of the National Building Code of Canada and supplements thereto and set building permit fees. Central Okanagan J currently referred to as the Central Okanagan West Electoral Area and formerly known as the Westside Electoral Area, was created from the merger of Electoral Area G and Electoral Area H. The 2005 population. exclusive of anyone living on an Indian Reserve, was 37,638 people. In 2007 most of the electoral area's population transferred to the jurisdiction of the newly-incorporated District Municipality of West Kelowna.

Central Okanagan G is a former regional district electoral area of the Regional District of Central Okanagan in south central British Columbia, Canada.  It is located in the northwest part of the district, and is on Okanagan Lake. Central Okanagan G was merged with Central Okanagan H to become Westside Electoral Area. The large populations residing on the Westbank Indian Reserve and other Indian Reserves within its boundaries are not represented by the regional district and are not within its jurisdiction.

Central Okanagan H is a former regional district electoral area of the Regional District of Central Okanagan in south central British Columbia. It is located in the southwest part of the district, and is on Okanagan Lake. Central Okanagan H was recently merged with Central Okanagan G. It is now also known as the Westside Electoral Area.

Information to be published in Gazette
1 (1) This regulation applies to the notices respecting letters patent that the minister is required to publish under section 15 (1) (a) of the Local Government Act.

(2) The minister's notice in the Gazette must include the following information:

(a) the name of the municipality, regional district or improvement district to which the letters patent relate;

(b) the number and date of the order in council by which the letters patent were issued, and the effective date of letters patent if different than the date of enactment;

(c) in general terms, the purpose of the letters patent;

(d) the authorizing legislative provision for the letters patent;

(e) where the letters patent may be viewed;

(f) if the letters patent include a boundary description, one of the following may be used in the notice:

(i) a synopsis describing the area and where a map of the boundary description may be viewed;

(ii) the legal description of the parcels affected;

(iii) a metes and bounds description of the area affected.

(3) Subsection (2) does not limit the minister's authority to include any other information the minister considers necessary or advisable.

THAT it is considered desirable and expedient that community planning be available throughout the Province of British Columbia to ensure orderly development:

AND THAT pursuant to the provisions of the "Local Services Act", the Lieutenant-Governor in Council may, upon the recommendation of the Minister of Municipal Affairs, establish any area of the Province not incorporated as a City, Town, Village or District Municipality as a local area for the preparation of community plans by the application of Divisions (1) and (6) of Part XXI of the "Municipal Act" and the regulation of land use, zoning, subdivision-control, and the construction of buildings or structures of any kind by the application of Divisions (2), (3), (4), (5) of Part XXI of the "Municipal Act":

AND THAT pursuant to the provisions of the "Town Planning Act", certain areas of the Province were established as regulated areas for the purpose of community planning:

AND THAT under the provisions of the "Local Services Act", certain areas of the Province were established as local areas for the purpose of community planning:

AND THAT the said regulated areas and local areas should be included within the local area established by this Order:

AND TO RECOMMEND THAT pursuant to clauses (a) and (i) of section 3 and section 4 of the "Local Services Act", all those lands lying within the territorial limits of the Province of British Columbia save and except those portions thereof which lie within the Corporate limits of a City, Town, Village, or District Municipality be established as a local area under the name of "Provincial Community Panning Local Area" for the following purposes:

(1) The preparation of community plans by the application of Divisions (1) and (6) of Part XXI of the "Municipal Act".

(2) The regulation of land use, zoning, subdivision-control and construction of buildings or structures of any kind by the application of Division (2), (3), (4) and (5) of Part XXI of he "Municipal Act".

AND THAT the Minister of Municipal Affairs may designate any area of the said Provincial Community Planning Local Area as a Community Planning Area wherein regulations for community planning may be imposed and may extend, alter or dissolve such Community Planning Areas and may merge two or more such Community Planning Areas:

AND THAT the regulations authorized to be imposed by the said Minister in any such Community Planning Area shall be deemed to be those authorized under Divisions (1) to (6) inclusive, of Part XXI of the "Municipal Act" and the Minister may make specific regulations for each Community Planning Area:

AND THAT the Orders in Council establishing the following regulated areas under the provisions of the "Town Planning Act" are hereby rescinded, namely:-

DEFINITION OF LETTERS PATENT
With respect to local government, Letters Patent is a legal instrument which is issued by way of an Order-in-Council of the Province of British Columbia and signed by the Lieutenant-Governor-In-Council, which may establish local government and improvement districts and set boundaries, establish services and may confer upon local governments certain and specific legislative powers.

SUPPLEMENTARY LETTERS PATENT
Supplementary Letters Patent may broaden the powers of local government by amendment to Letters Patent. The legislation adopted by the Provincial Government in 1964 with the recommendation of the Minister of Municipal Affairs, and with the approval of the Lieutenant-Governor-In-Council, could, by the issuance of Letters Patent, incorporate any area of land and the residents within that area in to a regional district for the purpose of carrying out functions and services as may be granted from time to time or conferred upon it by the Municipal Act. In addition to the functions and services conferred upon the regional district by the Municipal Act, the regional district had such functions as were provided by Letters Patent or Supplementary Letters Patents and for this purpose the Lieutenant-Governor-In-Council, upon the recommendation of the Minister, could provide in the Letters Patent or Supplementary Letters Patent, such further objects, powers, obligations, duties, limitations, and conditions in respect to any or all functions requested. Before the Lieutenant-Governor-In-Council issued the Letters Patent or Supplementary Letters Patent, a request to be granted the powers to undertake the function(s) must have been received from the regional board, and such a request had to specify the member municipalities or electoral areas which were to participate and the basis for sharing the costs of each of those functions. Before advancing such a request, the regional board must have received the consent of the council of each municipality which was to participate in the function, and would have submitted for and received the assent of the owners of land in each electoral area, which was also to participate, except where the function was of a regulatory nature.

4. No debt other than temporary current borrowing shall be incurred by the regional district for the purpose of this function.
5. Until the annual budget for the year 1969 is adopted, sums of money which may be borrowed to meet the current lawful expenditures of the regional district for the purposes of this function shall be as determined by the Inspector of Municipalities.

Division V. - Building Regulation
1. The provisions of section 798? of the Municipal Act apply to the regional district.
2. No debt other than temporary current borrowing shall be incurred by the regional district for the purposes of this function.
3. Until the annual budget for the year 1969 is adopted, the sums of money which may be borrowed to meet the current lawful expenditures of the regional district for the purposes of this function shall be as determined by the Inspector of Municipalities.

And whereas, by supplementary Letters Patent issued on the 15th day of August, 1968, the boundaries of Electoral Areas C, D, and F of the said regional district were redefined and an additional electoral area designated Electoral Area I was created:

Don't know if this map above is for Zoning bylaw #66, 1972 but we received Zoning bylaw #66, 1972 and the 3 maps listed with bylaw #66 on the bylaws webpage through this Freedom of Information request.  We have since asked for more detail for Electoral Areas D and E through Freedom of Information request dated April 24, 2009, but have yet to receive anything.  I think I remember we received a letter from RDCO that I will post later that says RDCO doesn't have more detail or something... have to go find it now.

And whereas the Regional Board of the said regional district has indicated that Electoral Areas C and I as described in the supplementary Letters Patent issued on the 15th day of August, 1968, are locally known by their opposite designations and has been requested the designation be revised;

Therefore, His Honour the Lieutenant-Governor in Council has been pleased to order that Appendix A of the Letters Patent of the Regional District of Central Okanagan as amended be further amended by
(a) striking out the designation "Electoral Area C" and substituting the designation "Electoral Area I"; and
(b) striking out the designation "Electoral Area I" and substituting the designation "Electoral Area C."
And that the Letters Patent as amended of the Regional District of Central Okanagan be deemed to be further amended accordingly.

WHEREAS pursuant to the provisions of section 766 of the Municipal Act on the recommendation of the Minister of Municipal Affairs the Lieutenant - Governor in Council may by supplementary Letters Patent, extend the area of a regional district or add such further objects, powers, obligations, duties, limitations, and conditions as are deemed to be in the public interest and subsections (2) to (6) apply mutatis mutandis;
And whereas the provisions of sections 795 to 798D of the Municipal Act apply to the Regional District of Central Okanagan:
And whereas under the Local Services Act certain regulations apply to the areas known as Community Planning Areas 1 and 2:

Now know ye that We do order and proclaim that on, from, and after the date hereof the following be added to the objects, powers, obligations, duties, limitations, and conditions of the Regional District of Central Okanagan and for that purpose the Letters Patent of the regional district be amended by: -
1. Adding the following paragraphs to Division IV - Regional and Community Planning: -
"6. On and after the 30th day of November, 1969, the provision of the British Columbia Regulations 21/60 as amended to the above date remain in force and effect in the area established as Community Planning Area 1 described in The British Columbia Gazette dated the 28th day of January, 1960, as if they were bylaws adopted by the Board pursuant to Divisions 1Official Community Plan, 3 zoning, and 4 subdivision of land of Part XXI of the Municipal Act Community Planning until such provisions are amended or repealed by by-law in accordance with the provisions of the said Act.
"7. On and after the 30th day of November, 1969, the provisions of the British Columbia Regulations 495/59 as amended to the above date remain in force and effect in that portion of the area established as Community Planning Area 2 described in The British Columbia Gazette dated the 24th day of November 1959, which lies within the boundaries of the Regional District of Central Okanagan as if it was a by-law adopted by the Board pursuant to Divisions 3 zoning and 4 subdivision of land of Part XXI of the Municipal Act Community Planning until such provisions are amended or repealed by by-law in accordance with the provisions of the said Act."

2. Adding the following paragraph to Division V - Building Regulation: -
"4. On and after the 30th day of November, 1969, the provisions of the British Columbia Regulations 147/66, 262/66, and 67/68 as amended to the above date remain in force and effect in the areas established as Community Planning Area 1 and that part of Community Planning Area 2 which lies within the boundaries of the Regional District of Central Okanagan and as if they were by-laws adopted by the Board pursuant to Division 5 Building Regulations of Part XXI of the Municipal Act Community Planning until such provisions are amended or repealed by by-law in accordance with the provisions of the said Act."
And that the Letters Patent of the Regional District of Central Okanagan be deemed to be amended accordingly.
