Valley of the Sun is interested in the water system regulations for their subdivision that may have existed in 1970 when Valley of the Sun subdivision was approved.

Regional District of Central Okanagan History (page 25)

Initial regulations pertaining to the management of land use and subdivision established for Community Planning Area No. 1 under Supplementary Letters Patent, approved by the Provincial Government on October 27, 1969.

Division (3) of Community Planning Area No. 1 Regulations pertaining to subdivision repealed March 17, 1971 and replaced by Subdivision Regulations 262/70 of the Local Services Act.

Zoning Amendment Bylaw No. 66 adopted on September 6, 1972 in order to apply zoning regulations to the Electoral Areas of the Regional District.

[6] The Regional District was originally incorporated by Letters Patent on August 24, 1967 and is now incorporated under the provisions of the Municipal Act, R.S.B.C. 1996, c. 323. On November 30, 1969 the Regional District assumed responsibility for, among other things, community planning and building regulation from the Central Okanagan Regional Planning Board (the “Planning Board”) by Supplementary Letters Patent.

[7] The Department of Highways has at all material times been responsible for granting approval of the Subdivision.

Municipal Act 1960 Chapter 255
Interpretation

Improvements for the purposes other than levying school rates includes

a) reservoirs and storage tanks of whatever kind or nature

b) water, pipe-lines for transportation of water

c) rafts, floats, docks, and other such devices which are anchored or secured, whether the land or property to which they are anchored or secured belongs to the owner or not, and storage-tanks

but does not include such other than rafts

Improvements for the purpose of levying school tax rates includes

a) reservoirs

b) pipe-lines for the transportation of water

d) rafts, floats, docks, storage tanks

 

Municipal Amendment 1969 s. 639 (2).amended by striking out the words "or local district" in the first line.

 

 

Amends s. 464.
2. Section 464 of the Act, as amended by chapter 37 of the Statutes of British Columbia, 1960, is further amended by striking out the words "village or local district" in the second line of subsection (2) and substituting the words "or village".

(2) Upon the application of an owner of land within the development area or his agent, the Council may, by the issuance of a development permit, waive the provisions of the by-law as they apply to that land and substitute therefor other terms and conditions which shall have the effect of a by-law adopted under section 702.

698 (1) The Council shall not authorize, permit, or undertake anything contrary to or at variance with the official community plan or a plan adopted under Division (6) of this Part.

699 (1) An official community plan does not commit the Council or any other administrative body to undertake any of the projects therein suggested or outlined, and is a statement of policy only.
(2) The adoption of a community plan does not authorize the Council to proceed with the undertaking of any project except in accordance with the procedure and restrictions laid down therefor by this or some other Act. 1957, c. 42, s. 696.

711. (2) Every approving officer shall give due regard to and take cognizance of any official community plan when dealing with applications for the approval of any plan of subdivision.
(3) The approving officer may refuse to approve a subdivision plan if he is of the opinion that the cost to the municipality of providing public utilities or other municipal works or services would be excessive.

October 13, 1969

WHEREAS pursuant to the provisions of section 766 of the Municipal Act on the recommendation of the Minister of Municipal Affairs the Lieutenant - Governor in Council may by supplementary Letters Patent, extend the area of a regional district or add such further objects, powers, obligations, duties, limitations, and conditions as are deemed to be in the public interest and subsections (2) to (6) apply mutatis mutandis;
And whereas the provisions of sections 795 to 798D of the Municipal Act apply to the Regional District of Central Okanagan:

How do you figure out the square feet of your lot you ask?


If you were to measure how large Lot 60 (in the diagram above) would be in Square Feet,
not saying this is the correct way to do it, but this is how we did it.

Notice the underlined numbers in red in the diagram of Lot 60 above.  These are the numbers we are using to show you how we figured out how many square feet Lot 60 is.

Take 139.68 + 133.43 then divided in half = 136.56

Then take 122.16 + 128.00 then divide in half = 125.08

Then take the 136.56 and times it by the 125.08 = 17,080.92 square feet

It says in the Dec 24, 1959 BC Gazette Part II - More - The minimum area of a parcel of land into which land may be subdivided is 15,000 square feet where no community water-supply is available.
