Fire Department Operative Bylaw No. 414, 1970
adopted July 7, 1970

Being a bylaw to provide for the operation of fire departments in local service areas.

WHEREAS the Regional Board of the Regional District of Central Okanagan by bylaw established the following local service areas for the purpose of providing fire protection and suppression:
  • Joe Rich Fire Protection Local Service Area

  • North Westside Road Fire Protection Local Service Area

  • Wilson's Landing Fire Protection Local Service Area

  • Ellison Fire Protection Local Service Area

  • Carr's Landing, Coral Beach, Juniper Cove Fire Protection Local Service Area

APPARATUS - means any vehicle provided with machinery, devices, equipment or materials for fire fighting and rescue service as well as vehicles used to transport fire fighters or supplies.

EQUIPMENT - means any tools, contrivances, devices or materials used by the Fire Department to combat an incident or other emergency.

FIRE CHIEF - means the member appointed by resolution by the Regional Board, as head of the Fire Department and shall be deemed to be a Municipal Public Officer as defined in the Municipal Act.

FIRE PROTECTION means all aspects of fire safety including but not limited to fire prevention, fire fighting or suppression, pre-fire planning, fire  investigation, rescue service, public education and information, training or other staff development and advising.

5. The Fire Chief has complete responsibility and authority over the Fire Department subject to the direction and control of the Regional Board to which he shall be responsible; and in particular he shall be required to carry out all fire protection activities and such other activities as the Regional Board directs including but not limited to:

    (a) rescue,
    (b) other incidents,
    (c) pre-fire planning,
    (d) disaster planning,

6. The Fire Chief and the Board of Trustees in the case of the Carr's Landing, Coral Beach, Juniper Cove Fire Protection Local Service Area, , subject to ratification by the Regional Board, shall establish rules, regulations, policies and committees necessary for the proper organization and administration of the Fire Department including but not limited to:

    (a) use, care and protection of Fire Department property,
    (b) the conduct and discipline of officers and members of the Fire Department, and
    (c) efficient operations of the Fire Department.

22. The Fire Chief or the member in charge of an incident may request persons who are not members to assist in removing
furniture, goods and merchandise from any building on fire or in danger thereof and in guarding and securing same and in demolishing a building or structure at or near the fire or other incident.


23. The Fire Chief or the member in charge of an incident is empowered to commandeer privately owned equipment which he considers necessary to deal with an incident. Remuneration may be paid by the Regional Board.

Killiney Beach Community Specified Area Establishment and Loan Authorization by-law No. 84
adopted March 19, 1975

1. The Regional Board is hereby empowered and authorized

(1) to establish in Electoral Area "G" a specified area defined as follows and is to be known as the "Killiney Beach Specified Area" and such area shall be comprised of that tract of land as set out in Appendix A, attached to and forms part of the by-law.

(2) to undertake and carry out or cause to be carried out and provide fire Protection Equipment in and for the said specified area and to do all things necessary in connection therewith.

  (a) to borrow upon the credit of the regional district a sum not exceeding $5,000.
  (b) to acquire all such fire protection equipment as may be necessary.

2. The entire cost of providing fire protection equipment shall be borne by the owners of land in the said specified area and
a sum sufficient therefore shall be levied and raised in the manner prescribed in the "Municipal Act" in each year commencing
with the year 1975, for such period of time as is necessary, on all lands and improvements, on the basis of assessment as
fixed for taxation for school purposes, excluding property that is taxable for school purposes only by special Act, within the said specified area.

Killiney Beach Community Temporary Borrowing Bylaw No. 186, 1979
adopted November 5, 1979

1. The Board is hereby empowered and authorized to temporarily borrow upon the credit of the Regional District from the Canadian Imperial Bank of Commerce, Kelowna, British Columbia, an amount or amounts not exceeding $ 5,000.00, plus interest charged thereon for the purpose of providing temporary financing for the purchase of equipment for the specified area of Electoral Area "G".

North Westside Road Fire Protection and Loan Authorization Bylaw No. 310 - Repeals No. 84
adopted December 1, 1986

The entire cost of providing fire protection shall be borne by the owners of land in the said Specified Area and a sum, not to
exceed $1.35 per $1,000.00 of assessment
, shall be levied and raised in the manner prescribed in the "Municipal Act" in each year commencing with the year 1987 for such period of time as is necessary, on land and improvements on the basis of assessment as fixed for taxation for hospital purposes, within the said Specified Area.

North Westside Road Fire Protection Local Service Area Establishment and Expansion Bylaw No. 548, 1993 - Converts Bylaw No. 310 - Amended By Bylaw No. 899, 908 & 1126
adopted April 5, 1993

1. The fire protection specified area created under Bylaw No. 310, cited as the "North Westside Road Fire Protection Specified Area Establishment and Loan Authorization By-law No. 310, 1986", is hereby established as a local service for that portion of Electoral Area 'G' as described in Schedule 'A' to this bylaw, and known as the North Westside Road Fire Protection Local Service Area.

2. The Local Service Area established by this Bylaw is hereby expanded to include that area shown outlined on Schedule 'B' attached to and forming part of this bylaw. (adds 4 - 10 acre parcels at Valley of the Sun)

3. The maximum amount that may be requisitioned for annual costs for the service provided under Sections 1 and 2 of this Bylaw shall not exceed $1.35 per $1000.00 of net taxable value of land and improvements within the service area.

4. The annual costs to be collected improvements for service area shall be recovered by requisition of monies by a property value tax levied on land and regional hospital purposes, within the service area.

5. The fire protection service established by this bylaw shall carry out all fire protection activities within the service area including but not limited to:

    (a) fire suppression and prevention
    (b) rescue
    (c) disaster planning

6. The Regional Board of the Regional District of Central Okanagan is hereby authorized to enter into mutual aid agreements respecting the use of equipment and personnel to provide assistance inside or outside of the service area, to the specific clause of circumstances set out in Clause 5 of this bylaw, that may cause harm to persons and property.

** Note Bylaw 1065, 2004 states the following:

by deleting in Section 5(a) the words "and prevention".

adopted October 16, 2000

AND WHEREAS it is desirable to provide that a Medical First Responder service be included in the powers permitted in the North Westside Fire Protection Local Service Area;

adopted October 29, 2001

The boundaries of the North Westside Road Fire Protection Local Service Area Establishment and Expansion Bylaw No. 548, 1993, are hereby amended to include such property as outlined in Schedule "A" attached hereto and forming part of this Bylaw. Ridgeview Development Fire Protection Service Area Establishment Bylaw No. 909, 2000
adopted October 29, 2001

AND WHEREAS a request has been received by the Regional District of Central Okanagan to extend the North Westside Road Fire Protection Service Area to include a parcel of land located within a portion of Electoral Area "G" and known as the Ridgeview Development;

AND WHEREAS the Regional Board deems it necessary to construct a fire storage garage and purchase fire fighting equipment in order to provide this service;

AND WHEREAS the Regional Board of the Regional District of Central Okanagan wishes to establish a service for the purpose of constructing the fire storage garage and purchasing the fire fighting equipment;

1. The Regional District hereby establishes within Electoral Area "G", as shown outlined on Schedule 'A' attached to and forming part of this Bylaw, a service to construct a fire storage garage [Shorts Creek Fire Hall is our guess] and purchase fire fighting equipment and to be known as the "Ridgeview Development Fire Protection Service Area" [Ridgeview is DL 3850 also known as La Casa].

2. The participants in the service, established under Section 1, are a portion of Electoral Area "G" and the boundary of the service is the boundary outlined on Schedule "A". [The boundary map shows it encompasses Ridgeview DL 3850 which is La Casa]

3. The annual costs for the service established in Section 1 shall be recovered by:

    a) The requisition of money under Section 806, to be collected by a parcel tax
        imposed in the manner provided by Section 806.1(1)(b) of the Local Government Act.

    b) The imposition of fees and other charges that may be set by separate bylaw for the
        purpose of recovering these costs.

4. The maximum amount that may be requisitioned annually under Section 803 (1) (b) for costs of the service shall be $22,000.

*** So $22,000 divided by approx. 500 total parcels at La Casa = $44.00 each La Casa (Ridgeview) parcel. ***

Ridgeview Development Fire Protection Service Area Loan Authorization Bylaw No. 910, 2000
adopted October 29, 2001

Being a bylaw to authorize the borrowing of Two Hundred and Twenty Thousand Dollars ($220,000.00) for the purpose of providing fire protection to the Ridgeview Development;

WHEREAS a request has been received by the Regional District of Central Okanagan to extend the North Westside Road Fire Protection Service Area to include a parcel of land located within a portion of Electoral Area "G" and known as the Ridgeview Development;

AND WHEREAS the Regional District of Central Okanagan has established by Bylaw No. 909, a service area for the purpose of constructing the fire storage garage and purchasing fire fighting equipment;

** Note the service area is only La Casa

AND WHEREAS pursuant to Section 797.4 of the Local Government Act, the Regional District of Central Okanagan has obtained a sufficient petition for the service;

AND WHEREAS the monies to be borrowed are for the construction of a fire storage garage and purchase of fire fighting equipment;

AND WHEREAS the total amount of debenture debt of the Regional District authorized under:

  (a) Section 830 of the Local Government Act (SECTION 828-836 NOW REPEALED) in respect of
       short term capital borrowing is $13,860;

  (b) Section 831 of the Local Government Act in respect of loan authorization bylaws is $15,236,780;

  (c) Section 831.1 of the Local Government Act in respect of loan authorization bylaws is Nil;

  (d) Section 835 of the Local Government Act in respect of the financing of municipal undertakings is $58,438,234;

AND WHEREAS the amount of existing outstanding debenture debt of the Regional District authorized under:

  (a) Section 830 of the Local Government Act (SECTION 828-836 NOW REPEALED)in respect of
       short term capital borrowing is $4,020;

  (b) Section 831 of the Local Government Act in respect of loan authorization bylaws is $8,576.878;

  (c) Section 831.1 of the Local Government Act in respect of loan authorization bylaws is Nil;

  (d) Section 835 of the Local Government Act in respect of the financing of municipal undertakings is $50,555,784;

AND WHEREAS the amount of debenture debt that is authorized but is not issued under:

  (a) Section 830 of the Local Government Act (SECTION 828-836 NOW REPEALED) in respect of
       short term capital borrowing is $8,700;

  (b) Section 831 of the Local Government Act in respect of loan authorization bylaws is $6,993,600;

  (c) Section 831.1 of the Local Government Act in respect of loan authorization bylaws is Nil;

  (d) Section 835 of the Local Government Act in respect of the financing of Municipal undertakings is $7,882,540;

AND WHEREAS the amount of principal or interest that, as of the date of the adoption of this bylaw, is in arrears on debt created under Sections 830, 831, 831.1 and 835 of the Local Government Act (SECTION 828-836 NOW REPEALED) is Nil;

AND WHEREAS the authority to borrow under this bylaw expires five years from the date on which this bylaw is adopted;

AND WHEREAS the maximum term for which a debenture may be issued to secure the debt created by this bylaw is for a term not to exceed 20 years;

NOW THEREFORE THE REGIONAL BOARD OF THE REGIONAL DISTRICT OF CENTRAL OKANAGAN IN OPEN MEETING ASSEMBLED ENACTS AS FOLLOWS:

Loan Authorization

1. The Regional Board is hereby authorized and empowered in conjunction with the establishment of the Regional District of Central Okanagan Ridgeview Development Fire Protection Service Area Establishment Bylaw No. 909.

    a) To borrow on the credit of the Regional District a sum not exceeding Two
        Hundred and Twenty Thousand Dollars ($220,000) for the purchase of property,
        building, fire trucks and ancillary equipment
;

    b) To acquire all such real property, easements, rights-of-way, licences, rights or
        authorities as may be requisite or desirable for or in connection with the
        establishment and operation of the Regional District of Central Okanagan
        Ridgeview Development Fire Protection Service Area;

** Note $22,000 max annual requisition x 10 years = $220,000

Fire Prevention Services Establishment Bylaw No. 1065, 2004 - Amends 404, 416, 418, 548, 1021, 1044, 1058
adopted August 9, 2004

Being a bylaw to establish a service of fire prevention and to amend Regional District of Central Okanagan North Westside
Road Fire Protection Local Service Area Establishment and Expansion Bylaw No. 548,

WHEREAS the Local Government Act requires that a Regional District Board must first adopt an establishing bylaw for a service;

AND WHEREAS the Regional District of Central Okanagan wishes to establish the Service of Fire Prevention for those areas of the Regional District that are not within the boundaries of the District of Peachland, the City of Kelowna, or the District of Lake Country;

AND WHEREAS the Directors of the Westside Electoral Area and the Director of the Ellison/Joe Rich Electoral Area have consented to the establishment of the service area;

NOW THEREFORE, the Regional Board of the Regional District of Central Okanagan in open meeting assembled enacts as follows:

1. The fire prevention services established by this bylaw shall be limited to the following activities:

  a) Education of the residents about fire hazards.
  b) Adoption and enforcement of regulations dealing with fire prevention,
  c) A system of fire prevention inspections of public buildings,
  d) Adoption and enforcement of fire department access standards.
  e) Supplemental Regulations for fire hydrants.
  f) Regional District Fire Department Administration.

2. The boundaries of the fire prevention services established by this bylaw shall include all of Westside Electoral Area and Ellison/Joe Rich Electoral Area.

3. The participants in the service are the Westside Electoral Area and Ellison/Joe Rich Electoral Area.

4. The maximum amount that may be requisitioned for the annual operating costs for the service shall not exceed $0.15 per $1,000.00 of the net taxable value of land and improvements within the service area.

5. The annual costs of operating the service shall be recovered by property value taxes imposed on the net taxable value of land and improvements in the participating area, and fees and charges imposed in accordance with Section 803 of the Local Government Act.

9. To amend "The Regional District of Central Okanagan North Westside Road Fire Protection Local Service Area Establishment and Expansion Bylaw No. 548, 1993" by deleting in Section 5(a) the words "and prevention".

** Note Bylaw 548 states the following:

5. The fire protection service established by this bylaw shall carry out all fire protection activities within the service area including but not limited to:

    (a) fire suppression and prevention

but will now instead state the following:

    (a) fire suppression and prevention

Fire Prevention and Regulations Bylaw No. 1066, 2004 Consolidated Version - Amended by Bylaws 1157, 1184
adopted August 9, 2004

A Bylaw to provide for Prevention of Fires and to Provide for Regulation of Persons at or Near Fires.

WHEREAS the Regional District of Central Okanagan has adopted the Regional District of Central Okanagan Fire Prevention Services Establishment Bylaw No. 1065, 2004.

AND WHEREAS the Regional District of Central Okanagan may establish regulations necessary for the Regional District of Central Okanagan to help protect the public from the effects of fire.

NOW THEREFORE the Regional Board of the Regional District of Central Okanagan in open meeting assembled, enacts as follows:

Purpose
The purpose of this bylaw is to enact the regulations necessary for the Regional District of Central Okanagan to utilize the B.C. Fire Code and additional local policies to help to protect the public from the effects of fire.

Prevention
In addition to the requirements of the B.C. Fire Code, the B.C. Building Code and the Fire Services Act:

c) The owner or occupant of real property shall keep their buildings and yards clear of anything that may unduly increase the probability or danger of fire.

e) No person or persons shall allow accumulations of empty boxes, barrels, rubbish, trash, waste paper excelsior, or any light combustible materials, in any alley or on any sidewalk or premises; except that such materials may be stored in a room or receptacle of fire resistive construction fitted with fire doors, or in metal containers equipped with tight fitting lids.

g) Where required by the British Columbia Fire Code as amended from time to time, the owner or occupant of any lands, premises, yards or buildings shall at all times keep the same in a safe condition by:

    iii) maintaining fire department vehicle access in accordance with Section 2.5 of the British Columbia Fire Code;

    ix) maintaining fire hydrants in an approved manner as Section 6.6.4 of the British Columbia Fire Code;

Fire Hydrants
In addition to the requirements of the B.C. Fire Code:

c) The owner of a parcel on which a hydrant is installed shall maintain a clear and unobstructed area having a radius of one meter around each fire hydrant or standpipe.

Smoke Alarms
In addition to the requirements of the B.C. Building Code and Fire Code:

c) Smoke alarms required by this bylaw shall conform to CAN/ULC-S531, Standard for Smoke Alarms and shall be installed and maintained in conformance with CAN/ULC, S553 Standard for the Installation of Smoke Alarms,

d) No person shall drive a vehicle over any fire department equipment without permission of the Fire Chief or persons he designates to work on his behalf.

Fire Department Operative Amendment Bylaw No. 1067, 2004 - Amends Bylaw 414
adopted August 9, 2004

1. Amend the bylaw preamble by deleting the words "Carr's Landing, Coral Beach, Juniper Cove Fire Protection Local Service Area,"

2, Amend the definition of Fire Protection by deleting the words "fire prevention".

3. Delete the definition of Incident and replace it with "means a fire or any situation where fire or explosion is imminent and includes assistance response circumstances described In Section 5 of this bylaw."

4. Amend Section 9 by deleting the words "the purpose of fire prevention inspections" and replace with the words "any purpose pursuant to this bylaw and the Fire Services Act".

5. Delete Sections 6, 10, 11, 12, 13, 14, 15, 16, 17, 18, 19, 20, 21, 22 and 23 in their entirety and renumber the remaining sections in numerical order,

North Westside Road Fire Protection Service Area Amendment Bylaw No. 1126, 2005 - Amends Bylaw No. 548
adopted Dec 12, 2005

1. The "Regional District of Central Okanagan North Westside Road Fire Protection Local Service Area Establishment and Expansion Bylaw No. 548, 1993" is hereby amended as follows:

a) That Section 3 be deleted and replaced with:
"3. The maximum amount that may be requisitioned for annual costs for the service provided under Section 1 of this Bylaw shall not exceed $1.83 per $1,000.00 of net taxable value of land and improvements within the service area for the years 2006 to 2010, and that commencing 2011 the maximum amount that may be requisitioned for annual costs for the service provided under Section 1 shall not exceed $1.35 per $1000.00 of net taxable value of land and improvements within the service area."

b) That Section 4 be deleted and replaced with:
"4. The annual costs for the service shall be recovered by requisition of monies under Section 806 of the Local Government Act to be collected in the manner provided by Section 806.1, by a property value tax levied on land and improvements for regional hospital purposes, and by a parcel tax."

c) That the following subsections be added:
"4.1 The amount to be requisitioned and recovered by a parcel tax shall be fifty dollars ($50.00) per parcel per year for a period of five (5) taxation years commencing in 2006. Monies raised from the parcel tax will be transferred to the equipment replacement reserve fund."

"4.2 In the years 2006 to 2010 the maximum amount that may be requisitioned excluding the amount in section 4.1 for annual costs shall not exceed $1.35 per $1000.00 of net taxable value of land and improvements within the service area."

2. The Regional Board hereby directs that the parcel tax to be imposed in the North Westside Road Fire Protection Service Area be deposited in a reserve fund for the purpose of accumulating monies for the purchase of fire response related equipment for the fire protection service area.

5. The fire protection service established by this bylaw shall carry out all fire protection activities within the service area including but not limited to:

    (a) fire suppression and prevention

Being a bylaw to amend the Regional District of Central Okanagan Fire Prevention and Regulations Bylaw No. 1066, 2004.

1. Amend the preamble of the bylaw by adding a new third paragraph as follows:

"AND WHEREAS the Wildfire Act will continue to apply for those parts of the Regional District of Central Okanagan outside the boundaries of the Regional District of Central Okanagan service area fire departments."

2. Amend the section headings throughout the Bylaw by numbering them as follows:

    1) Purpose
    2) Definitions
    3) Regulations
    4) Prevention
    5) Fire Hydrants
    6) Smoke Alarms
    7) Open Burning
    8) Inspections
    9) Authority of Fire Chief
    10) Severability
    11) Prohibitions
    12) Penalty

3. Add the following definitions alphabetically in Section 2):

"Air curtain burning" means burning in a trench or in a manufactured above grade enclosed burner using a mechanical air system to force air into the fire to accelerate burning while producing minimal visible smoke.

Fire Prevention and Regulations Amendment Bylaw No. 1184, 2006 - Amends Bylaw 1066, Amended by Bylaw No. 1240
adopted Sept 25, 2006

A Bylaw to amend the Regional District of Central Okanagan Fire Prevention and Regulations Bylaw No. 1066, 2004.

1. Delete section 7) I) in its entirety and replace it with the following:

"I) Regardless of the issuance of a permit, the person to whom a permit for open burning has been issued shall not burn unless the venting index as provided daily by Environment Canada is sixty five (65) or greater when the fire is started.".

Fire Prevention and Regulations Amendment Bylaw No. 1240, 2008 - Amends Bylaw 1184
adopted May 26, 2008

WHEREAS the Regional District of Central Okanagan has enacted the Regional District of Central Okanagan Fire Prevention and Regulations Bylaw No. 1066, 2004, as amended by Bylaw No. 1157, 2006 and Bylaw No. 1184, 2006

1. Delete section 7) u) in its entirety and replace it with the following:
"7 u) The Fire Chief may issue permits for burning with the time periods from October 1st in one year to April 30th of the following year."

2. This bylaw may be cited as the "Regional District of Central Okanagan Fire Prevention and Regulations Amendment Bylaw No. '1240, 2008".

Did you know you can call Wayne Watson if you have combustible waste to get rid of? The wood waste is used for a bonfire for the kids in the winter.
