WE RECEIVED NOTHING FROM RDCO IN THIS FOI REQUEST WE MADE FEB 3, 2010
MOST LIKELY BECAUSE WE WERE IN VIOLATION OF RDCO's BUILDING POLICY, AND RDCO PROBABLY DIDN'T WANT US TO HAVE THE INFORMATION!

To Chief Building Inspector Ray Paterson:

I received your awful letter dated January 22, 2010.

One thing I would like to mention is that I never, as your Jan 22, 2010 awful letter states, told you that I have “no intention of allowing further inspection unless it fits my schedule”. These words are not mine, but are rather a statement you made up yourself without hearing or listening to anything I said in all my letters. I said I would not let my building permit expire, did I not? My initial intention was to try and adhere to building bylaw 835. In my letters I said I would have my building inspected before my permit expires on June 2, 2010. I also said that I would have the building inspected by a professional company and that I don’t trust RDCO’s inspections, did I not? Will RDCO not permit a professional company to inspect? You didn’t reply to my letter and tell me otherwise? Can you please explain if RDCO will not permit a professional company to inspect if that is the case, and why not?

I want confirmation on what is required in order for you to grant occupy of my building, because I don’t understand Regional District bylaw 835 requirements. What does the definition of “wall finish” mean for instance? What does my building require to be granted an occupancy permit? Does it need a kitchen counter or what? You said the building didn’t have to be complete but you didn’t say otherwise. At what stage can an occupancy permit be granted? You never did answer this same question which I have asked you a couple of times now, but you instead sent me a copy of the bylaw that I already had access to on the internet the first time I asked and had already read it. I asked you again because I still don’t understand by reading bylaw 835, but you ignored me the second time. Will I be ignored again this time I wonder? How can I comply, if I don’t understand bylaw 835 or what the definition of wall finish means, and you never explain it? Bylaw 835 is a Regional District bylaw and I feel the Regional District should be the one to explain what is required if I don’t understand, especially if the bylaw does not define the answer. To me wall finish could mean many things including vapour barrier, paint, gyproc, stucco exterior, etc.. I am unsure what RDCO bylaw 835 is referring to by using the wording “wall finish”, can you please explain. This is my third time asking and my last.

I want confirmation from you that if my building is not ready for an occupancy permit and I cannot comply, does RDCO want me to move out in order for RDCO to NOT place a title notice on my property? Please don’t ignore this question as it is very important to me. If I cannot comply with an occupancy permit can you please confirm what alternatives I have other than having to move out of my building and/or paying money for a title notice to be removed? For instance maybe you have a low income application form to grant occupancy when a building does not comply, or an application form for special circumstances? Maybe you have other options available? If there are no other options available to me, then please advise me of that fact.

If you do place a notice on the title of my property can you please confirm how I go about disputing a notice you place on the title of my building? Will it cost me money, and how much? Are there time limits to dispute a title notice? Where do I go to apply to dispute notice you place on my title? Where do I go to start the process, is it the court house or does RDCO have another type of bylaw dispute program? Can you please advise?

Can you please explain what you feel in your opinion is the difference between a Board policy and a building bylaw? I want to be sure I understand you, and that is why I am asking. In your opinion, is there any difference between a Board policy and a bylaw?

I am unsure about what the proposed water system will cost, or if grants can or will be obtained. I have doubts about further grants. I cannot afford to build my building until after such time as I know if I have enough money to pay the $17,500 for the water system. If I can not come up with the entire $17,500 by the time the water system is installed and payment is due, I will be forced to sell because I will definitely not be able to afford $54,000 over 30 years, which $54,000 divided by 30 years = $1,800 each year for 30 years. For me living by myself, I can buy bottled water cheaper. I am having a hard time trying to survive as it is, and I have no idea what is going to happen in the end. I have doubts that I will come up with the amount of money required for the water system in such a short period of time, but miracles sometimes do happen and so I am hoping. If I am forced to sell then I will never be granted an occupancy permit and the building will need to be finished and completed by someone else who buys it.

If you do decide to have a Board meeting to try and have the Board members place notice on the land title, I would like to be able to speak to the Board members about it, and tell them how you are trying to place words in my mouth that are untrue in your letter. I would also like to remind Board members of certain sections of Bylaw 835 that I feel you fail to understand. If you continue to move forward to place notice on my land title, please place me on the delegates list and advise me of the date and time so I may attend.

Please confirm the questions I have asked of you in my letter instead of ignoring me further, unless of course you don’t know the answers. I deserve more respect from you than what you have given me so far, if you do know the answers. If you continue to avoid answering my questions, how can I possibly know how to comply, and how can I trust that you even know the answers yourself?

July 9, 2009 RDCO passed their policy that you have to build within 4 years

THAT The Regional Board endorse the policy for closing inactive building permits/stop work orders with a bylaw contravention notice:

1. Building Permits that are inactive for more than one year period

2. Buildings that are occupied without approval where occupancy has not been granted regardless of time-frame.

3. Building Permits that are still active but are not completed within four years from the date of permit issuance.
