This is a letter from Ministry of Community and Rural Development in reply to a Freedom of Information Request asking for information telling us if a community water system was required or not required at subdivision approval back when Valley of the Sun was approved Aug 18, 1970 by the Dept. of Highways approving officer.

The Ministry of Community and Rural Development Advisory Services Branch sent this letter dated Sept 24, 2010 along with some attachments which we posted at the links listed below the Letters Patents below the letter.  We did not receive the Letters Patents from the Ministry of Community and Rural Development.  We listed the Letters Parents here in regards to water or sewage just so the links are handy and so that people know these things exist.  Myself I never heard of letters patents until lately so I imagine many people never heard of them. 

What are letters patents?
Letters Patents basically laws which describe the rules, regulation or power that the local government is given by the province.  The letters patents tell local government what powers they can use to govern us with.  For instance a letters patent could give a regional district the power of garbage disposal, or weed control, or dog control, etc.  There are many letters patents made or amended over the years, and there are different letters patents between regional districts, or local governments.

 

 

 

The letter above dated Sept. 24, 2010 from the Ministry of Community and Rural Development Director of the Advisory Services Branch says Valley of the Sun was in Community Planning area #1 and that the powers under the Regulation were granted to the Regional District by .pdf icon Supplementary Letters Patent dated October 30, 1969.  The problem with that is that Valley of the Sun may not have been within Community Planning Area number 1 until Sept 6, 1972. In RDCO's historical review you can find at the link immediately prior to this sentence it explains that the Regional Board did not expand the Community Planning Area #1 provincial regulations to all electoral areas of the Regional District until Sept. 6, 1972.  The director also says that Regional District of Central Okanagan had no authority or obligation to operate a community water system for any of its member areas (electoral areas).

That Division (3) of B.C. Regulation 495/59 (insofar as such regulations relate to the Regional District of Central Okanagan) and B.C. Regulation 21/60 as amended, and by Supplementary Letters Patent approved on October 27, 1969 [I am told they can't find October 27, 1969 Letters Patent] applied as if they were by-laws adopted by the Regional District of Central Okanagan, are hereby repealed.

3. The member municipalities of the regional
district are as follows.-
(a) Municipalities. City of Kelowna and The Corporation
of the District of Peachland.
(b) Electoral areas.  Electoral Areas A, B, C, D, B, F, G,
and H, the boundaries of which are described in
Appendix A attached to and forming part of these Letters
Patent
.

It says under Division I Local Works and Services,
With  respect to that part of the regional district not within a city, district, town or village municipality, the regional district has all the powers of a district municipality under Part XVI of the "Municipal Act." except sections 589 and 590, and the provisions of the said Part, except sections 589 and 590, apply mutatis mutandis.

Municipal Act XVI Sections 589 and 590 are to do with Local Improvements - Division 1 - General

a) reservoirs and storage tanks of whatever kind or nature

b) water, pipe-lines for transportation of water

c) rafts, floats, docks, and other such devices which are anchored or secured

It says under Division II Contract Works and Services quote,
The regional district may undertake any work or service for and on behalf of any member municipality, other than an electoral area, upon such terms and conditions as are mutually agreed upon, provided such work or service is within the powers of the municipality and provided that the entire cost of any such work or service shall be apportioned to the municipality.

There is no LP DIV III section listed on RDCO's website although the Index says there is one? BUILDING REGULATIONS
So we asked through FOI and this is what RDCO sent us.

The Directors of the Regional Board were to be elected by each community “Electoral Area” together with appointed representatives from councils of municipalities. Only the directors of communities contributing toward the cost of particular services would vote on matters affecting that service. Several agencies were involved in the provision of services to the unorganized territories, as follows:

1. Department of Municipal Affairs Provincial Building Inspector issued permits for the construction of residential and commercial buildings if the proposals complied with zoning, health, highways, water rights and any other agency requirements that may be applicable.

2. The Provincial Government agent issued business licenses for uses in existing buildings, based on the zoning regulations in effect over that property.

3. The Department of Highways issued access permits to properties fronting highways under its jurisdiction, but approval of access for commercial use was based on the Community Planning Area Nos. 1 & 2 Zoning and Development Regulations in effect over any particular property. It also acted as the formal Approving Officer for subdivision of land.

4. The Regional Planning Division, Department of Municipal Affairs in Victoria, had the responsibility for the planning regulations in effect in Community Planning Area Nos. 1 & 2, an extensive area covering part of the arable and habitable land within School District No. 23 that was not within the City of Kelowna or the District of Peachland, and on which much urban and rural development was taking place. These regulations governed general use of land (zoning, building regulations and, in liaison with the Department of Highways and the Medical Health Officer, subdivision standards)

5. The Central Okanagan Regional Planning Board acted as the Community Development and Planning Advisor in an advisory capacity only to:
• The Department of Municipal Affairs in Victoria for all unorganized territory totalling some 98.7 percent of the total land area of School District No. 23.
• Municipal Council, City of Kelowna
• Municipal Council, District of Peachland

There were many improvement districts and local utilities within School District No. 23, who were responsible for domestic and irrigation water, fire protection and other services. There are still some improvement districts and private utilities in existence today.
