Jan - Dec 2010 there were 77 building permits issued in Central Okanagan West.  In the entire Regional District of Central Okanagan there were 48 single family dwellings built, 38 residential additions and access and 32 permits were for garages and carports.

Building Inspection Schedule Changing

Starting Monday, March 5th, 2012 building inspections will only be available three days a week - Tuesdays, Wednesdays and Thursdays.
The change reflects the construction market and reduced demand for building permits in the Central Okanagan East and Central Okanagan West electoral areas.

The Regional Board has adopted an updated Subdivision Servicing Bylaw. Following a comprehensive review of the previous bylaw which was adopted in mid-1997, the changes reflect current provincial regulations, best practises and establish standards for servicing subdivisions within the unincorporated electoral areas. It also takes into consideration development trends that have emerged in the electoral areas over the past 19 years.

Service Reviews Supported

The Regional Board has received a number of reports following scheduled reviews of eleven separate services. The Board supports the continued service delivery model for the following regional and sub-regional services: Solid Waste Collection, Crime Stoppers, Crime Prevention, False Alarm Reduction and Victim Services.

Two of the services reviewed that are funded by ratepayers in the two Electoral Areas are supported by the Electoral Area Directors for continued delivery: Business Licensing and Unsightly Premises Bylaw Enforcement. The two Directors support the continued delivery of Okanagan Regional Library Services in the Electoral Areas while staff pursues concerns about using the most accurate and reflective population figures to ensure a fair proration of funding requisitions.

The Electoral Area Directors received the service reviews for Noise Control Bylaw Enforcement, Building Inspection and Electoral Area Fire Prevention and will meet with the Chief Administrative to discuss service delivery options including potential withdrawal from the service.

SUBJECT: Building Inspection Program - Service Review
Purpose: To bring forward recommendations from the Governance & Services Committee with regard to the service review for the Building Inspection Program.

Executive Summary:
The attached service review report was presented at the November 12, 2015 Governance & Services Committee meeting and the following resolution was adopted:
THAT the Governance and Services Committee recommend the Board continue to support the current service delivery model for the Building Inspection Program;
AND FURTHER THAT the Board direct staff to review and update Building Bylaw No. 835 for Board consideration.

The Administrator noted that establishment bylaws will be reviewed as there are new sections in the Local Government Act that came into effect January 1, 2016 that may apply to the bylaws.

k) Building Inspection Program (Central Okanagan East & West Electoral Areas - Weighted Vote)

Staff report dated January 4, 2016 outlined the 2015 service review for the electoral area building inspection program.
The electoral area directors wish to look at whether this service can be contracted out.
It was noted that this service had previously been reviewed as a possibility to contract out and it was shown not to be feasible. None of the municipalities were interested in contracting this service. It was noted there are multiple areas within
the region that receive the service: North Westside, Brent Road, Trepanier, Joe Rich, Ellison, etc.

Purpose: To present a Service Review Report for the Building Inspection Program and confirm if there are any additional issues the Board wishes to have addressed.

Executive Summary:
On January 16, 2014 the Board approved a Service Establishment Bylaw Review Schedule that has every service the Regional District provides reviewed every five (5) years. In 2015 the Building Inspection Program is one of ten services that are subject to review. In preparing this Service Review Report staff reviewed the program's mandate, goals, and activities to confirm we are achieving the Board's objective of providing efficient, cost effective services.

The primary objective of this program is to provide effective and efficient building inspections within the Electoral Areas to ensure compliance with all applicable codes and regulations as well as maintain files and records of all historic and current building permits.

The Building department is currently meeting the Board's mandate and requirements of the public, although staff has identified a few areas that the Board could consider for review, amendment and improvement. Areas for review include updating the Building Bylaw and associated fee schedules to maintain consistency with surrounding jurisdictions and cost
recovery as well as an approved method to fund operational reserves when budget surpluses are realized.

At this time staff would be pleased to answer any questions the Board may have regarding this report and ask the Board if it has any other issues they would like followed up on in this review.

RECOMMENDATION:
THAT the Governance and Services Committee recommend the Board direct staff to review and update Building Bylaw NO.835 and bring back to the Board for consideration
AND THAT the Governance and Services Committee recommend the Board continue to support the current service delivery model for the Building Inspection Program.

7.10 Building Inspection Program (Central Okanagan East & West Electoral Areas)

Staff report dated November 3, 2015 outlined the building inspection program servicing the two electoral areas. The objective of this program is to provide effective and efficient building inspections to ensure compliance with all applicable
codes and regulations. Areas of review going forward include updating the Building Bylaw and associated fee schedules to maintain consistency with surrounding jurisdictions and cost recovery.

Director Carson noted he and Director Hanson do not support the service and questioned whether the private sector could do the program.

In 2012, a review of the service was done on an alternate service delivery model.

The Board did not endorse using outside contract management of the service but supported the provision of service by RDCO staff. The municipalities (West Kelowna, Lake Country and Kelowna) were not interested in engaging this service
as it would not be cost effective partly due to the extended travel time.
Taxation to support the service began as permits were considerably down. The program is a more self-funded model now as permits have increased.

FINDLATER/BAKER
THAT the Governance and Services Committee recommend the Board continue to support the current service delivery model for the Building Inspection Program;
AND FURTHER THAT the Board direct staff to review and update Building Bylaw No. 835 for Board consideration.

Item 6.4 Quarterly Program Measures Report

044 - Building Inspection (Page 95): Surplus of $100,961 is due to higher than anticipated permit revenues and inspections fees. In 2014, 143 building permit application were made and 128 building permits were completed. Building permit applications in 2013 totaled 162 and in 2012 totaled 130.

Construction value of permits issued has increased to $18,351,930 in 2014 compared to the 2013 value of $10,384,823. In 2014, 19 Stop Work Orders were placed on construction projects found underway in the two electoral areas compared to 36 Stop Work Orders placed in 2013 and 10 placed in 2012. Eight hundred closed building permit files consisting of close to 18,000 document pages were converted from paper to electronic imagery. The Building Inspector position increased to full-time effective April 2014. The Inspector is currently testing a mobile tablet in the field which is expected to provide greater efficiencies once the Vadim database is fully integrated with the proposed Noratek mobile software. 2014 Capital Expenditures were for Orthophotos, and a Fujitsu Scansnap with LED LCD Monitor.

043 - Business Licenses
At June 30, 2014, Total Business Licenses: 188. At June 30, 2013, there were 169 businesses licensed. Locations of businesses licensed: 172 RDCO East & West and 16 out of area.

044 - Building Inspection
Tax requisition for building inspection continued in 2014 in order to maintain a consistent level of building inspection services. Building permit applications are increasing, resulting in higher revenues as reflected with $65,975 in fees collected to June 30,2014 compared to $51,763 to June 30, 2013. To June 30, 2014, 60 building permit applications have been made and 41 building permits were completed. Building permit applications to June 30, 2013, totaled 77. Stop Work Orders continue to increase compliance and ensure building codes are met. Sixteen Stop Work Orders have been placed
in the first half of 2014 on construction projects found underway in the two electoral areas compared to eleven Stop Work Orders placed in the first half of 2013. Field inspection reports also continue to increase and are complaint based or are the result of unauthorized activity. These inspections may initiate stop work orders, building permit, development or licensing applications.

Purpose:
To provide the Regional Board with information and an update on Bill 17 - Miscellaneous Statutes Amendment Act.

Executive Summary:
Bill 17 - Miscellaneous Statutes Amendment Act includes a number of amendments. Specific amendments which will affect the Regional District of Central Okanagan include the intent to terminate all land use contacts (LUC) in the province by June 30, 2024, in addition to streamlining the bylaw approval process by removing unnecessary ministerial approval.

Taxation (Rural Area) Act - The proposed amendments to the act will provide the province authority to issue tax notices to a single representative, rather than each owner, on properties that have more than a prescribed number of owners. The changes will help streamline processes, avoid taxpayer confusion and duplicate payments, and they will bring B.C.'s legislation in line with how other jurisdictions administer property taxes.

Local Government Act, Community Charter and Vancouver Charter - The proposed legislative amendments will support economic development by cutting red tape that can delay building projects and add costs for developers and landowners.
Amendments to the Local Government Act, Community Charter and Vancouver Charter will remove unnecessary ministerial approvals for land use planning and development decisions, allow modern land use policies and practices to replace outdated land use contracts and protect developers from increases in development cost charges.

The intent of this component of Bill 17 is to streamline the approval process for all regional districts adopting OCP's, zoning or subdivision servicing bylaws, issuing temporary use permits and amending LUC's by exempting all regional districts from ministerial approval for these types of bylaws.

Executive Summary:
John Hailstones has been employed as a Building and Business License Inspector with the Community Services department since October 30,2012. Non-compliance issues within the Building and Business License program are a regular occurrence. John Hailstone's Board appointment will provide for additional tools and depth within his principal accountabilities and within other bylaw enforcement contingencies.

RECOMMENDATION:
THAT John Hailstones be appointed as a Bylaw Enforcement Officer for all Regional District of Central Okanagan bylaws while employed with the Regional District of Central Okanagan.

September Building Statistics Report

During September, the Regional District approved 13 building permits for construction projects valued at $191,000 in the Central Okanagan East and Central Okanagan West Electoral Areas. That compares with nine permits issued during the same month last year for projects worth a total of $641,113. During the first nine months this year 116 building permits have been approved for projects worth an estimated $6.4-million. From January through September 2012, 93 building permits were approved for projects valued at just over $6.8-million.

August Building Statistics Report

During August, the Regional District approved 11 building permits for construction projects valued at $299,400 in the Central Okanagan East and Central Okanagan West Electoral Areas. That compares with 8 permits issued during August 2012 for projects worth a total of $227,900. So far this year 103 building permits have been approved for projects worth an estimated $6.2-million. During the first eight months of 2012, 84 building permits were approved for projects valued at just over $6.2-million.

There’s been a marked increase in the number of illegal building projects underway in the Regional District of Central Okanagan.

So far this year, RDCO has placed stop work orders on 27 construction projects it has found underway in the Central Okanagan East and Central Okanagan West electoral areas. Central Okanagan West includes the North Westside.

“In many cases, it’s simply the oversight by the property owner, who has undertaken the work themselves,” said Bruce Smith, with RDCO.

Building permits are required for construction and renovations of any structure, including fireplace installations, sewer systems, fences and outbuildings and inspections are required to approve various stages of construction.

The fees for building permits range according to the size and type of structure.

“Ensuring compliance with the B.C. Building Code and regional district building bylaw is in everyone’s best interest,” said Smith.

“It makes sure that all structures, construction and renovations are done in a safe manner. Homeowners that don’t follow the permitting process could find themselves facing insurance and other issues down the road.”

Electoral Area Building Projects Require Permits

There’s been a marked increase in the number of illegal building projects underway in the Central Okanagan East and Central Okanagan West Electoral Areas.

So far this year, the Regional District has placed Stop Work Orders on 27 construction projects it has found underway in the two electoral areas.

Communications Officer Bruce Smith says, “Even though we were down to one Inspector for six months in 2012, that’s more than three times the number of Stop Work Orders issued during the same time last year. In many cases, it’s simply the oversight by the property owner, who has undertaken the work themselves. Our staff proactively enforces the Building Bylaw and administers the BC Building Code. They also respond to complaints from residents about unpermitted construction and renovation projects.”

Smith adds, “Basically, building permits are required for construction and renovations of any structure, including fireplace installations, sewer systems, fences and outbuildings and Inspections are required to approve various stages of construction. The fees for building permits range according to the size and type of structure.”

044 - Building Inspection

Organizational restructuring resulted in a Manager of Inspections and Fire Services position filled effective April 2013 by Dan Wildeman. This position oversees the Fire Protection and Inspection Services Departments. Both electoral areas have a special one year requisition for 2013 to provide a consistent level of building inspection services due to lower revenues generated from permit fees. To June 30, 2013, 77 building permit applications have been made. Building permit applications in 2012 totaled 63 at June 30 and 130 for the year. Construction value of permits issued continues to decrease as shown when comparing the June 30, 2013 value of $3,371,053 to the June 30, 2012 value of $4,531,235.

Building Inspector has an adjusted work week allowing for fielding of questions from the weekend and providing improved customer service. Information Services dept. is currently in the process of purchasing a tablet computer and approving a program to allow field entry and uploading upon returning to the office to improve efficiency and effectiveness. Chief Building Inspector, Ray Paterson, retired after 23 years with the Regional District.

111 - Electoral Area Planning
Application fee revenue is $7,200 higher than budgeted at June 30; three development applications totaled $11,000. To June 30, 2013, 33 lots have subdivided and 69 development enquires have been made, a significant increase compared to 4 lot subdivisions and 25 development enquiries at June 30, 2012. Fringe Area Planning cost sharing agreements work plan was presented to the Board in May 2013. Draft maps and fringe area agreement document with financials details to be prepared in the third quarter. Groundwater Study initiatives were completed in March 2013 in conjunction with OBWB and the Province regarding the location and drilling of the Ellison monitoring well. Joe Rich Rural Land Use Bylaw amendment was adopted changing the land use designation on a property to allow the owner to subdivide into two lots and bringing it in line with similar designations provided for other properties.

Planning Services:
Organizational restructuring resulted in the creation of Community Services headed up by Director Chris Radford. Community Services oversees Planning Services. Ron Fralick was promoted to Manager of Planning Services effective January 1, 2013. An exemption from the requirement for ministerial approval on RDCO bylaws has been granted due to clear demonstration of the department to work effectively with referral agencies and the Province to address issues as they arise early during the bylaw review process. This exemption will streamline and reduce processing time for approval of both private landowner and RDCO initiated development applications and other bylaws subject to the exemption regulation.

110 - Regional Planning
Regional Growth Strategy: Continued consultation among the local governments, Provincial Ministries, stakeholders, Westbank First Nation and staff to finalize draft RGS Agreement. The updated Regional Growth Strategy is anticipated to be adopted in the fall of 2013. Aggregate Supply & Demand Study: A draft study, representing a key milestone of 70% completion of the project, was presented to the G&S Committee, referred out to agencies and made available to the public on June 13, 2013. Both the RGS and Aggregate Supply & Demand Study draft updates are available online at www.futureok.ca. The Board has accepted the proposed RGS and Fringe Area policy amendments for the neighbouring Thompson-Nicola Regional District. Development of Bio-Diversity Conservation Strategy carried forward from 2012 has progressed with the finalization of the Methodology and Analysis Report; inclusion of mapping in the RDCO amalgamated environmental data set and review of Draft 2 of the Connectivity document and Strategy. Staff update: Permanent part-time employee moved into a fulltime term position to replace staff member on leave. Relief employee was hired to fill the part-time position during the term.

6. Finance & Administrative Services

6.1 Quarterly Program Measures Report - Year-to-date June 30, 2013

The quarterly measures report, year-to-date June 30, 2013, Executive Summary was presented for information. Staff highlighted areas of note including:
• At the end of June budgets are on track. Budget revision will come forward in regards to capital costs.
• Restructuring of staff has occurred - existing and new staff.
• Trepanier Fire - paid on call reimbursement has been received from Ministry of Forests. Surplus has been reflected in revenues. The past practice is to top up paid on call wages to $30 for incident and budget remainder into reserves. Reimbursement is reflective of what other fire departments are paid for response. The question was raised whether it sets a precedent to reimburse paid-on-call at this rate? The question was raised whether the Board need to approve a policy change or is this administrative in nature? Staff noted this is within the existing budget. Need to be consistent across other communities, staff to confirm that it is consistent in the region.

OPHUS/ZIMMERMANN
THAT staff provide a report to the Board on the policy for reimbursement of paid on call emergency response for fires such as the Trepanier Fire, confirming the practice for reimbursement is consistent in the region.

5. Community Services

Environmental Planning:

5.1 OBWB collaboration and Okanagan Wetland Strategy--presentation by Anna Warwick-Sears and Nelson Jatel (Okanagan Basin Water Board)
Anna Warwick-Sears introduced the topic of collaboration between the Water Board and RDCO. Solutions to water issues are bigger than one jurisdiction.
Director Baker arrived at 8:37 a.m.
Through the OBWB grant program, the RDCO and partners have been involved in a number of projects including: sensitive habitat inventory mapping; best management practices illustrations; hydrogeological assessments and modeling of aquifer systems in the central Okanagan; stream restoration and education activities on Joe Rich Creek; the "silvopasture" project in Vernon and Oyama Creek watersheds; Okanagan Lake foreshore inventory mapping; and wetland inventory, collaboration and prioritization.
Nelson Jatel provided an update on the Okanagan Wetland Strategy and the ground water study. RDCO Community Services Planning Section is working in collaboration with the Okanagan Basin Water Board (OBWB) on a number of initiatives related to water conservation and quality, including input on the Regional Growth Strategy.
Director Stack arrived at 8:47 a.m.
Regional planning function is imperative to the strategy as it has to be bigger than Central Okanagan boundaries. The majority of funding comes from senior governments. Wetlands are the 'kidneys' of the environment. The Strategy is looking at emerging issues and collecting the dots between data currently available and future data.

Discussion:
- Director Baker noted that Lake Country is supporting a resolution at UBCM to get more staffing in environment offices in the Okanagan. Jatel noted they don't see a trend for increased staffing being re-routed to the environment. The answer is going to rest in new solutions to consider and dealing with constricted budgets.
- If new sources of revenue are taxed, need to ensure the funds are being directed to the areas identified.
- Are there any results back from the Joe Rich water study? The data from Joe Rich is just beginning-limited data sets available, still playing catch-up. It is imperative to share data in a meaningful way to help local government in the decisions they are required to make when it comes to development.
- Is the OBWB looking at working with local governments on storage of water, particularly high level? Storage is something that is done by individual water utilities. Storage is multi-jurisdictional as well - province, local governments, First Nations.
- Lobbying provincial representatives re: water quantity/quality affects health care.
- It is one water basin, We all have to work together to protect water sources,
- One of the issues RDCO is looking at is the emergency program for climate change including: continuity of service, adaption including catastrophic events, flood risk assessments/mapping critical to the future.

ZIMMERMANN/FIELDING
THAT the presentation by Anna Warwick-Sears and Nelson Jatel, Okanagan Basin Water Board on the Okanagan Wetland Strategy be received for information.

5.2 Habitat connectivity in the Okanagan Region--presentation by Dr, Lael Parrot (UBC-O) Species at risk

Another collaborative environmental planning project that has been partially funded through RDCO is the Biodiversity Conservation Strategy. The information and mapping on habitat connectivity that has been developed in conjunction with the
project, together with the land use information from the Regional Growth Strategy update, has led to a partnership with UBCO to further refine habitat connectivity across the RDCO area, The objective of this project is to assist in identifying a terrestrial network of patches and corridors whose conservation or restoration may contribute to maintaining habitat connectivity for a broad range of species in the Okanagan Basin. Restoring habitat connectivity once it has been lost is considerably more costly and much less effective than conserving existing native habitat. Dr. Lael Parot provided a presentation on identifying priority areas for conserving habitat connectivity in the Okanagan Region.

The vision of the group: maintaining ecological functional landscape in the Okanagan; support and sustain native biodiversity; maintain habitat connectivity for native species throughout the valley and with Washington State.

Why is it important to maintain natural habitats? To maintain quality of life, local ecosystem is unique to Canada, 25% of species at risk are located here.

How much habitat is enough? Minimal values includes 40% of historic watershed wetland coverage; 50% native vegetation cover or more at the watershed scale to support most species and healthy aquatic system, 75% of stream lengths should be vegetated.

Some previous work has been done by Okanagan Collaborative Conservation Program and the South Okanagan Conservation Program. Objective of program was reviewed as well as the method of work UBC-O is doing. Working groups are being formed which includes Washington State. Species don't know about borders
- collaboration is imperative.

Discussion:
- As you do the mapping and analysis will remediation be done as well? The first step is to identify what we have in the current landscape that can be conserved.

Remediation gets into a whole other field which would need funding. This project may identify priority areas.
- How do you anticipate local governments to be involved? That is why they are here today - currently contact is with local government staff.
- The challenge in conservation is identifying where subdivisions are - what is on public lands, what is on private lands.
Director Gray arrived at 9:35 a.m.
- Important to review/look at restrictive development to protect the natural landscape. Need to look at extreme scenarios - public dialogue will be important.
- What is the timeline to present some information to staff/board? Connectivity maps - 12 to 18 months. Honor thesis available by May 2014. Larger project simulation models - 5 year project plus.
- Important to establish environmental contacts with each of the municipalities staff can assist with this. Important to engage with all staff, at all levels.
- Bringing First Nations in is critical at the beginning of the process and bringing in their values as well.
- This work fits in with the Regional Growth Strategy.

Building Inspection Services Tax Requisition
The Regional Board has endorsed a plan to initiate a tax requisition for 2013 from property owners in the electoral areas to fund building inspection services. The additional tax requisition will provide funds needed to cover total expenditures for building inspection services in the two areas. Based on 2012 assessments, an average home valued at $490,000 in Central Okanagan East will pay $28.42 while the average home valued at $462,000 in Central Okanagan West will pay $26.80. With the downturn in construction experienced in the areas over the past few years, revenues from permits fees have not kept pace with expenditures even though there have been reductions in staffing and inspection days to try and reduce costs. In recent years, many local governments and regional districts have begun to rely on a tax requisition to maintain a consistent level of building inspection services.

October Building Statistics
During October, Development Services approved 22 building permits for a construction projects valued at $1,657,939 in the Central Okanagan East and Central Okanagan West Electoral Areas. That compares with 19 permits issued in October 2011 for projects valued at $1,763,325. During the first 10 months of 2012, 115 building permits have been approved in the electoral areas for projects valued at $8.5-million. During the same period last year, 147 permits were approved for construction projects totalling more than $11.1-million.

CONFLICT OF INTEREST OR WHAT?
Of course RDCO Chief Building Inspector will sign himself his own pay cheque!!!

Chief Building Inspector Ray Patterson would sign saying he needed to be paid more money .. an extra $90,000 that will now be charged to us on our taxes.  Each property will pay almost $30 to increase retroactively Ray Patterson's pay cheque.

Incompetence or what.. ... when RDCO knew for the last year or more that there would be a shortfall RDCO did nothing to exterminate the shortfall. RDCO only reduced the shortfall slightly.

Why didn't Ray Patterson work 2 days per week long time ago .. he's working 2 days a week now? Ray works Tues and Wed.  And why did RDCO need a part-time inspector .. couldn't Ray Patterson keep up?

Did you know Ray Patterson is retiring.  Probably won't be making enough money now.  RDCO new Chief Building Inspector's name is John somebody.

7.2 Report to Initiate a Tax Requisition for Building Inspection Services in the RDCO Electoral Areas (All Directors - Unweighted Vote)

Staff report dated November 20th outlined the required tax requisition for the 2013 budget for the electoral area building inspection service. A one-time tax requisition of $104,841 from both electoral areas ($45,563 for Electoral Area East and $59,278 for Electoral Area West) is required due to a projected deficit.

As Regional Districts are unable to carry forward a deficit budget, a tax requisition will be required for inspection services for 2013.

Due to the construction slowdown from 2009 to present many local governments have been faced with a reduction in permits and thereby a reduction in fees. Building Inspection staff has been reduced to two days per week in order to reduce the projected deficit. Currently, this staffing level is managing the required inspections.

It was noted in the future when surpluses are available, the Regional District should establish a reserve to help when the economy is in a downturn. It was noted the deficit cannot be charged to any other service, as the Local Government Act requires that an area that receives the service, pays for the service. Taxation for building inspection is becoming quite common in other local governments. The service will be adjusted throughout the year if required
to prevent any future deficit.

THAT the Regional Board approve inclusion of a tax requisition from the Regional District Electoral Areas for the 2013 Building Inspection portion of the Building Inspection and General Bylaw Enforcement Services program budget.

5.2 David Dubois, Project Coordinator, Green Heat Initiative (SIBAC-Southern Interior Beetle Action Coalition) re: Biomass Heating Potential at the request of the Southern Interior Beetle Action Coalition, Director Edgson being the Board's delegate to the committee, the project coordinator David Dubois for the Green Heat Initiative, provided an update on the potential for biomass heating.

Funding and services are potentially available for local governments to implement biomass heating systems in local government buildings. As part of SIBAC funding, Dubois is available to travel to communities to provide information on green heat.

Staff report dated October 23fd noted that there are currently no regional district buildings that would clearly benefit by switching to biomass heating, however the information is presented for the Committee's information.

Dubois noted that the system is highly sophisticated requiring little manpower to operate. A consistent, sustainable fuel supply is always the challenge with a system. This type of system requires a very small piece of the 'overall puzzle' in the amount of debris available. In the Central Okanagan there is a large demand for clean construction waste, ogogrow operations and Tolko go-generation. Under certain circumstances this type of heat source makes sense where transportation costs are low and where gas is not available.

RDCO staff highlighted what is going on the region regarding biomass heating.
There is no obvious building in the regional district to move to a wood waste heat source. The question was raised about the region's community halls ie: Joe Rich.
Staff noted that a brand new air source heat pump has recently been installed in Joe Rich. The North Westside community hall is considering upgrades but they can choose whatever system they wish-the hall does not belong to the Regional District.

It was felt that a system like this should be paid by the users not taxpayers in general. If there is nothing in our current capital plan for upgrades why would any time be spent considering a system? If an upgrade to a system is being considered in the future staff may consider if a system such as this is feasible.

Discussion
-It was noted that West Kelowna is interested in receiving further information on the RFID program and staff will update Council in the future.
-West Kelowna will look at trunk lines in the near future. It's a low priority for them.
-School site acquisition - approved by the Province, developers will be required to pay a fee in the future.
-Information provided to Kelowna for review of boundary extension.
-What are the financial implications of reduced recycling and reduced income is there a way to offset costs? Staff is focusing on reduction programs (paper free program) paying less processing costs when it ends up in the recycling bins - it's the only thing that can be done to offset costs. Material is not being returned to the landfill. There is no shutdown for recyclables. The material that is recycled here is sent to relatively local markets (not China) plastics go to the Lower Mainland, paper to Washington. We can stockpile if required but there is no ability for reduced transportation costs as we use local markets. Where does the money go for electronics? The Electronics Stewardship of BC - they run the program, collecting, marketing, hauling, processing and they fund depot operations.

Zoning Bylaw No. 871 Amended

The Regional Board has adopted amendments to the Regional District Zoning Bylaw No. 871. The changes resulted from the annual review of the bylaw to ensure it remains consistent with Board policy and direction as well as to clarify interpretation and reflect development trends. Among the amendments to the bylaw are clarification of the intent of prohibited uses, bed and breakfast accommodation regulations, and the permitted area to be used for ‘Home Based Business – Major’ and ‘Home Based Business in an Agricultural Zone’.

That compares with 16 permits issued in July 2011 for projects valued at $587,440. So far this year, 76 permits have been approved for construction projects valued at $5.9-million. During the first seven months of last year, 92 construction projects received permits in the two electoral areas for a total value of just over $6.7-million.

2.3 2012 Budget Review

Marilyn Rilkoff began a review of the 2012 budget. The question was raised regarding FTE's (full-time equivalents) and whether the cost is applied to the department they report to or the service. FTE costs are allocated to individual services. If you participate in a service you pay a portion of FTE.

Building Inspection
- Building Inspection function has always been funded by the building permits not through tax requisition
- The service is not sustainable. Staff has been looking at options to reduce the service.
ACTION: Immediately reduce inspections to three days per week and that staff be directed to provide a report to the Board on what the service level and costs would be to contract out building inspection, and alternatively to provide a reduced service through the Regional District.

Inspection & Bylaw Enforcement Services:

043 - Business Licenses (Page 82): Invoicing for 2012 Business Licenses will be processed in November and due December 31,2011. Total Business Licenses: 191. Locations of businesses licensed: 170 RDCO East & West, 21 out of area. All municipalities participating in the Inter-Community Business License program have implemented a December 31 deadline. After December 31,2011, an additional $25 late fee will apply to any RDCO businesses applying for a 2012 license renewal. Business License Inspector is on leave of absence.

044 - Building Inspection (Page 84): It appears there will be a deficit at year end. To September 30, 2011, 143 building permit applications were made. Building permit applications in 2010 totalled 126 at Sept. 30 and 160 for the year. Thirty-three building permits were issued for water service connections in Upper Fintry and Valley of the Sun subdivisions. Inspections continue to be carried out 2 days for COW and 2 days for COE. Amendments to the RD Ticket Information Utilization Bylaw include new ticketing offences for relevant sections of Building Bylaw. Staff assisted for prosecution on a fire bylaw ticket served by the North Westside VFD Fire Chief. Proceeding was successful. Court appearance during the third quarter resulted from a 2010 disputed ticket. The outcome of the trial is scheduled for November 1, 2011. Due to a problem with the bylaw as highlighted by the Justice of Judicial Proceedings, the outcome is expected to be unsuccessful.

Ticket Bylaw Fine Changes

The Regional Board has approved amendments affecting the fees and fines structure in the Regional District Ticket Information Utilization Bylaw. The changes are the result of a review of the fines and fees structure of the Regional District and other local governments throughout the Central Okanagan and around the Province. Among the changes: fines for all infractions of the Sign Bylaw rise $50 to $100; fines under the Smoke Control Bylaw are elevated from $100 to $150 and fines under both the Animal and Noise Control bylaws are structured to include increasing penalties for a second and subsequent
infractions. As well, new ticketing offences have been added for relevant sections of the RDCO Building, Zoning, Subdivision and Development Servicing bylaws as well as for the Ellison and Rural Westside Official Community Plan bylaws and the Joe Rich Rural Land Use Bylaw.

SUBJECT: Amendments to Ticket Information Utilization Bylaw No. 435, 1990

RECOMMENDATION:
THAT Regional District of Central Okanagan Ticket Information Utilization Amendment Bylaw No. 1299 be given three readings and adopted.

BACKGROUND:
A review of housekeeping issues of the Regional District of Central Okanagan (RDCO) Ticket Information Utilization Bylaw No. 435 is one of the initiatives of the Inspections Section of Development Services.

Staff compared the current RDCO ticket fine amounts with those of the City of Kelowna, Penticton, Vernon and the Capital Regional District. The following changes are being recommended:

- Fees for the Sign Bylaw were elevated from $50 to $100 for all fines.
- Fees for the Smoke Control Bylaw were elevated from $100 to $150 for each fine.
- The Animal and Noise Control bylaw ticket fees are now structured to include an increase in fines for the second and subsequent offences.
- Four ticket fines of the two Parks bylaws that deal with dogs were elevated to $100 to match the fees of the Dog Control bylaw.
- The ticket fine for graffiti, under the Unsightly Premises bylaw was increased from $100 to $250 because the elevated fees of other Municipalities stood out at $250 and $1000.
- New ticket offences were added for sections of the Building, Zoning, Joe Rich Rural Land Use, Subdivision and Development Servicing, Ellison Official Community Plan and Rural Westside Official Community Plan bylaws. And, new ticket offence schedules No. 23 to 28 have been added for bylaws were there are currently none.

These changes will ensure that ticket bylaws match regulatory bylaws. Having ticket fines for bylaw sections that prohibit or regulate, will assist enforcement because instead of having to file a Long Form Information and Summons in Provincial Court, a ticket can be served and the choice to dispute is up to the person charged.

The question was raised whether the development community has been consulted. Staff noted they have met with UDI and CMHC and proposed there would be changes to the bylaw. Fee changes are consistent with City of Kelowna fees.

City court case breaks legal ground

Salmon Arm has been making history of sorts in the BC Court of Appeal​.

In July, the court ruled in a case involving the City of Salmon Arm that has attracted provincial attention. The interest is regarding the effectiveness of the provincial Riparian Areas Regulation, the regulation that is intended to protect fish habitat.

Andrew Gage, a staff lawyer with West Coast Environmental Law, wrote on his organization’s website that the court decision, “has confirmed that the province’s Riparian Areas Regulation (RAR) by itself provides little legal protection for fish habitat. The RAR is the province’s primary legal tool to protect fish habitat from development located immediately next to streams and lakes, and this decision should be very troubling to anyone concerned about the environment and the protection of fish.”

The issue began in 2007 regarding property at 741 Harbourfront Dr., east of Marine Park. The owners wished to build 15 metres from Shuswap Lake because of a limited building envelope and, under RAR, development is prohibited within 30 metres of fish habitat.

A Qualified Environmental Professional was hired to do an assessment, as required by the regulation, and he determined that the 15-m setback would not impact fish habitat.

The City of Salmon Arm approved the location, subject to the province’s Ministry of Environment and the federal Department of Fisheries and Oceans approving the plan.

Owner Gregory Yanke then challenged the RAR and the fact the city was deferring to the provincial and federal governments.

The challenge was successful in BC Supreme Court and when the case, which was listed as between the Attorney General of British Columbia, Gregory Yanke and the City of Salmon Arm, went to the BC Court of Appeal, the court criticized the government’s interpretation of RAR.

“You have a court saying neither level of government can step in under these laws to see if fish habitat is protected... It seems a fairly fundamental flaw,” Gage told the Observer, adding the decision makes it clear it’s a badly written piece of legislation.

“The court is saying the government doesn’t understand what its own laws are actually saying.”

The following excerpt from the Court of Appeal decision emphasizes Gage’s statement: “It appears that the Ministry of Environment, in consultation with the Department of Fisheries and Oceans and the Union of B.C. Municipalities, has developed a detailed (though not entirely consistent) regulatory framework for administering the Riparian Areas Regulation... The regulatory framework described in documents prohibits all development within streamside protection and enhancement areas... Unfortunately, the elaborate regulatory framework described in those documents is not supported by the Fish Protection Act or the Riparian Areas Regulation, and therefore has no basis in law.”

Carl Bannister, the city’s chief administrative officer, said the case has been complicated. The only reason the city was involved in the appeal, he said, was the Supreme Court had ruled that because the city had registered a covenant on the property in the mid-1990s regarding the floodplain, that RAR did not apply. The city argued that RAR still applied, and was successful.

“It was so clear that was never the intent of those covenants, so it was something we had to seek clarification on.”

He noted that the city had always supported the development and the issuance of the building permit for the property.

Bannister said the significance of the ruling is that it has global implications for the province.

“Basically the Court of Appeal said that the approval of the Ministry of Environment and Fisheries and Oceans Canada is not required in going through the RAR process, as long as there is no HADD, or harmful alteration, disruption or destruction of fish habitat. Essentially it puts a lot of the responsibility and authority on the qualified environmental professionals... whether or not the province intended that.”

He said it becomes similar to how regulation of construction in the province is turned over to the private sector, where architects and engineers take responsibility.

Questioned regarding the Court of Appeal decision, a spokesperson for the Ministry of Environment forwarded the inquiry to the Ministry of Forests, Lands and Natural Resource Operations.

Spokesperson Cheekwan Ho wrote an email response to several questions:

“• The province is still reviewing the implications of the decision;

• The decision does not fundamentally affect the model;

• The RAR is a proactive complement to the Federal Fisheries Act and Provincial Water Act;

• As long as QEPs follow the assessment methods and recommended variance process, and development is conducted consistent with the results, then potential violations of these acts will be avoided. Anything else may result in charges to the development and potential complaints of misconduct to the QEP;

• The province expects QEPs and development proponents to continue to practise due diligence in the application of the RAR and associated municipal bylaws to avoid or minimize impacts to the province’s important fish habitat.”

Meanwhile, the Court of Appeal decision is being watched on Salt Spring Island. An August article in the Gulf Islands Driftwood newspaper notes that the island’s Local Trust Committee is monitoring the Salmon Arm case regarding development in their area.

“It is interesting to watch and we, together with all municipalities, will be watching this carefully,” regional planning manager Leah Hartley is quoted.

August Building Statistics

During August, the Development Services Inspection Section approved 24 building permits for construction projects valued at $1,843,366 in the Central Okanagan East and Central Okanagan West Electoral Areas. During the first eight months of 2011, a total of 117 building permits were issued for projects worth more than $8.7-million. That compares with 105 permits issued during the same period in 2010 for projects valued at over $15.2- million.

RECOMMENDATION:
THAT the Regional Board approves Development Variance Permit application VP-11-07 to vary RDCO Subdivision and Development Servicing Bylaw No. 704, Schedule C.2, s.2 - Type & Extent of Servicing, by exempting the proposed 2 lot subdivision from the required servicing identified in Table C.2.2.; Reference Sections 6.03,6.06,6.11 and 6.12.

RATIONALE:
>- The subject parcel was originally two legal lots registered under Plan 16594 in 1966;
>- If approved, the variance and resulting subdivision will facilitate dedication of a 'Lane' to rectify the long-standing access issue by providing unrestricted legal access for the affected residents fronting Westside Road;
>- The variance will also facilitate routing and placement of a water main within the new road right-of-way associated with the RDCO's new Upper Fintry/Valley of the Sun Community Water System;
>- Non-approval of the variance will result in having to relocate the water main onto the Westside Road right-of-way resulting in low water pressure and potential for stagnant water in a dead-ended water main;
>- A qualified practitioner was commissioned to assess suitably for on-site sewage disposal.
The assessment indicates that both lots are suitable for Type 'I (conventional) on-site sewage treatment. The recommendations will be incorporated into a Section 219 covenant registered on titles at time of subdivision.
>- The subject parcel is located above Westside Road, a considerable distance from Okanagan Lake therefore on-site sewage disposal concerns from a lake impact perspective are negligible;
>- This variance represents an extenuating circumstance considered to be in the public interest and is not to be construed as representing staff or Regional Board support in future for requests to be exempt from the Community Sewer System requirement of Subdivision and Development Servicing Bylaw No. 704.

AGENCY REFERRALS:

Environmental Services Department staff has but one concern with this application, that being both proposed lots being less than 1 ha in size. They will support the variance on the condition that septic suitability is proven prior to subdivision. A Type 1 (conventional) on-site sewage disposal system has been proven feasible for both proposed lots in accord with a septic suitability report recently prepared by a Qualified Practitioner (DeansTech Consulting Ltd.). The recommendations of the August 3, 2011 report will be registered against the titles of the proposed parcels as S.219 restrictive covenants at time of subdivision.

The required servicing for which the applicant is requesting a variance (street lighting, sidewalks, curb and gutter, underground wiring, and sanitary sewer) do not exist in the area and they have no future plans to provide them.

DEVELOPMENT SERVICES STAFF COMMENTS:

Planning staff note that the request for exemption from the requirement of connection to a community sewage system represents the first such request to the Regional Board subsequent to Bylaw No. 704 being amended to incorporate this requirement. The requirement was precipitated in conjunction with Provincial direction for local governments to no longer allow subdivision of parcels less than 1 ha (2.47 acres) in size unless connected to a community sewer system as it could potentially impact approval of sewer grants. For this reason, Planning staff has consistently conveyed to the public that we would not support this type of variance request for subdivision approval.

As noted earlier, Environmental Services staff has provided rationale for supporting this particular application. Specifically, approval of the variance will facilitate dedication of a lane to rectify the incorrectly registered access easement by providing unrestricted legal access for the affected residents fronting Westside Road. The variance will also facilitate routing and placement of a water main within the lane right-of-way associated with the RDCO's new Upper Fintry/Valley of the Sun Community Water System. If the variance is not approved, the water main would have to be relocated within the Westside Road right-of-way resulting in low water pressure and potential for stagnant water in a dead-ended water main. A qualified practitioner was commissioned to assess suitability for on-site sewage disposal. The assessment indicates that both lots are
suitable for Type 'I (conventional) on-site sewage treatment. The recommendations will be incorporated into a Section 219 covenant registered on titles at time of subdivision.

It was ultimately discovered that the easement was incorrectly registered at time of the original subdivision in 1966. Incorrect registration of the easement essentially resulted in landlocked parcels for those lots fronting Westside Road (Lot 6 south to Lot 21) due to the physical access issue onto Westside Road as noted above. This matter also created difficulties for RDCO staff in not being able to provide house numbering to those landowners wishing to construct residences on the inaccessible vacant lots.

Development Variance Permits: (Unweighted Vote)

9.3 Development Variance Permit Application for David & Terry Willison (owner) located at 7225 Dunwaters Road & 7160 Westside Road. (VP-1107) Central Okanagan West Electoral Area (Electoral Areas, West Kelowna Fringe Area, Kelowna Fringe Area)

Staff report dated August 15th outlined the application to consider a request to allow exemption of a proposed two lot subdivision from servicing requirements of Bylaw No. 704. Staff reviewed the rationale, including:
• The subject parcel was originally two legal lots registered under Plan 16594 in 1966;
• If approved, the variance and resulting subdivision will facilitate dedication of a 'Lane' to rectify the long-standing access issue by providing unrestricted legal access for the affected residents fronting Westside Road;
• The variance will also facilitate routing and placement of a water main within the new road right-of-way associated with the RDCO's new Upper Fintry/Valley of the Sun Community Water System;
• Non-approval of the variance will result in having to relocate the water main onto the Westside Road right-of-way resulting in low water pressure and potential for stagnant water in a dead-ended water main;

Further to the posting of Notice of Application sign and neighbouring property owner notification process, a form letter (signed by 6 neighbouring property owners) and four additional letters/emails have been received supporting the application. In
summary, all of the letters/emails indicate that approval of the application will benefit all the affected properties fronting Westside Road by facilitating proper installation of the community water distribution system and rectifying the long-standing access issue.

Chair Hobson asked if there was anyone in the gallery who deemed their property affected by the variance. There were none.
The question was raised regarding Lots 6-21 being in the same circumstance for access--do you expect a variance for each property? Staff noted the lane has been secured for all properties except for the three most northern properties. An easement has been secured giving unrestricted access for all properties.

THAT the Regional Board approves Development Variance Permit application VP-1107 to vary RDCO Subdivision and Development Servicing Bylaw No. 704, Schedule C.2, s.2 - Type & Extent of Servicing, by exempting the proposed 2 lot subdivision from the required servicing identified in Table C.2.2.; Reference Sections 6.03, 6.06, 6.11 and 6.12.

July Building Statistics

During July, the Development Services Inspection Section approved 16 building permits for construction projects valued at $587,440 in the Central Okanagan East and Central Okanagan West Electoral Areas.

During the first seven months of 2011, a total of 93 building permits were issued for projects worth more than $6.8-million. That compares with 93 permits issued during the first seven months of 2010 for projects valued at over $13.9-million.

044 - Building Inspection (page 86): To June 30, 2011, 77 building permit applications were made. Building permit applications in 2010 totalled 54 at June 30 and 160 for the year. Eleven building permits were issued for water service connections in Upper Fintry and Valley of the Sun subdivisions. Inspections continue to be carried out 2 days for COW and 2 days for COE. In order to comply with the BC Building Code, the RDCO Building Bylaw has been amended and includes an updated evaluation schedule that is consistent with other local governments and more in line with present market values. The bylaw will assist in providing a more accurate valuation for residential construction projects.

During the first six months of this year, 77 permits have been issued by Development Services for construction valued at just over $6.2-million. During the same period of 2010, 86 building permits were issued in the electoral areas for projects worth just over $13.1-million.

From January through May this year, 63 permits have been issued by Development Services for construction valued at just over $5-million. During the first five months of 2010, 65 building permits were issued in the electoral areas for projects worth just over $10.7-million.

December Building Statistics

During December, the Development Services

Inspections Section approved seven building permits for projects worth $1,021,000 in the Central Okanagan East and Central Okanagan West Electoral Areas. During 2010, a total of 163 building permits were issued for construction projects in the
electoral areas totalling just over $19.8-million. That compares with 164 permits issued in 2009 for projects worth $13.9-million.

RDCO Building Bylaw Updated

The Regional Board has adopted amendments updating the Regional District Building Bylaw which has been in effect since May 1999. The revision brings the bylaw into compliance with the BC Building Code and includes an updated evaluation schedule that is consistent with other local governments and more in line with present market values. The bylaw will assist in providing a more accurate valuation for residential construction projects.

SUBJECT: Amendments to Building Bylaw No. 835
RECOMMENDATION:
THAT amendments to Building Bylaw No. 835 be given three readings and adopted.

BACKGROUND:
The Building Bylaw requires some specific amendments in order to be more compatible with the 2006 BC Building Code and for the Bylaw to provide an accurate way to establish current market construction values for single and two family homes, garages, carports decks and basement finishing.

The present evaluation schedule does not reflect the current construction market value. The schedule has not been amended since the adoption of the Building Bylaw on May 10, 1999. The implementation of the updated evaluation schedule will enable staff to issue Building Permits' with a more realistic market value construction level consistent with other local governments
within the Regional District.

The following are some of the highlights for the year from the Quarterly Report, but are certainly not all inclusive. We do recommend that the report and each program be reviewed, particularly with respect to "Department Initiative Status Reports", the "Summary of Year to Date Results", and Project Updates for the various programs. There are too many items too be covered in this summary, and everyone's level of interest in the various programs and departments varies.

Executive Summary:

Inspection & Bylaw Enforcement Services:

044 - Building Inspection (Page 82): To June 30, 2010, 54 building permit applications have been made. Building permit applications in 2009 totalled 75 at June 30 and 164 for the year. Twenty-three complaints were not responded to in the first quarter due to resource limits. These complaints have now been dealt with by either enforcement action, concluded, or forwarded to Business License Inspector for further investigation. Due to budget limitations the number of Inspections days has been reduced to 2 days for COW and 2 days for COE and 1 full day in the office to complete office duties (plan checking). A clerical position was to be suspended until the Permit values improved but the staff member in the position opted for early retirement. Fleet changes included the sale of two vehicles at auction and the sale of one vehicle to Weed & Insect Control.

July 8, 2010 Regional District of Central Okanagan Highlights of the Special Board Meeting

Smoke Control Bylaw

The Regional Board has approved a resolution asking staff to prepare an amendment to the Regional District of Central Okanagan Smoke Control Bylaw No. 733. The amendment is expected to address permit approval issues related to the
installation of outdoor wood burning boilers which do not currently have Environmental Protection Agency (EPA) standards.

New Provincial and industry emission standards are being considered and the bylaw amendment would reflect these initiatives.

1. RISE & REPORT - Governance and Services Committee meeting of July 8, 2010

1.1 Review of the RDCO Smoke Control Bylaw (Outdoor Wood Boilers) (Unweighted Vote - All Directors)

SHEPHERD/EDGSON
WHEREAS legislative changes to the Open Burning Smoke Control Regulation and the Solid Fuel Burning Domestic Appliance Regulation are currently being reviewed by the Province, industry is working to improve wood boiler emissions around CSA
and EPA criteria, and amendments to the solid fuel burning domestic appliance regulations are expected;

AND WHEREAS the Regional District is unable to prohibit the issuance of permits for the installation of outdoor wood boilers as Section 4.3 of the RDCO Smoke Control Bylaw No. 773 (consolidated) forms part of the bylaw and is in force;

AND WHEREAS given the problems that are caused by these boilers, and the current lack of CSA approved units, or experience with field operation of units meeting CSA and EPA standards;

THEREFORE, that staff be directed to bring forward an amendment to RDCO Smoke Control Bylaw No. 773 (consolidated) to remove the section referring to the EPA standard in Section 4.3 around the installation of outdoor wood burning boilers.

Staff report dated June 25, 2009 outlined recommendations on how the Regional District can deal with inactive building permits/stop work orders with a bylaw contravention notice. Concern had been expressed that the Regional District may
be allowing too much time for owners to comply with regulations.

SUBJECT: Inactive Building Permits/Stop Work Orders with a Bylaw Contravention Notice

RECOMMENDATION:
That the Regional Board endorse the following policy for closing inactive Building Permits/Stop Work Orders with a Bylaw Contravention Notice:

1. Building Permits that are inactive for more than a one year period.

2. Buildings that are occupied without approval where occupancy has not been granted - regardless of time frame.

3. Building Permits that are still active but are still not completed within four years from the date of permit issuance.

PURPOSE:
To examine the Procedure and Timing of Bylaw Contravention Notices on property titles where Building Permits are incomplete or unsafe conditions exist.

BACKGROUND:
The method of closing Building Permits is an on-going process. Regional District of Central Okanagan Building Bylaw #835 stipulates that the exterior finish of a building be completed within one year from the date of Permit issuance. The Building Permit is supposed to be completed within two years. The surcharge ($200.00, $100.00 or $50.00 depending on permit fee) is not refunded unless the permit is completed with two years from the date of issuance.

(Regional District Bylaw #835 says exterior complete within two years and not one year as the Chief Building Inspector states in his report)

(Regional District Bylaw #835 does not stipulate how long a building may take to complete so the Chief Building Inspector is wrong and misleading council)

For the most part the surcharge has been an incentive for permit holders to complete their project within the two years in order for the refund of the surcharge.

Within the Regional District there also exists a large number of non-permanent residents that do not the need or desire to complete their project within a timely manner.

As long as the project proceeds and the work does not stop for more than a six month period the permit file remains active.

(NOTE BYLAW #835 says permit will expire if no progress for one year)

When a Building Permit exists that is either older than two years or has not received an inspection within six months, the owner is sent a letter requesting a status update for the permit.

Staff have developed a system for keeping track of the permit status. If we are not successful in dealing with the permit holder, additionalletter(s) are sent informing them of a report to the Regional Board requesting a Notice be placed on the property title.

Our Staff will send four to five letters to the property owner before a Report is sent to the Regional Board. We have taken this approach for two reasons;

It provides the owner time to complete their permit if they are so inclined and shows due diligence on our part to bring closure to the permit file.

There are approximately three hundred and fifty-four open permits. All of the permits have been reviewed. Permits that have been inactive or non-compliant are being dealt with through our letter procedure.

Review of Bylaw Contravention Notice
A Bylaw Contravention Notice is placed on a Certificate of Title to limit the liability of the Regional District of Central Okanagan. The reasons for implementing this process are:

1. Failure to complete a Building Permit to the minimum standards as required by the Regional District of Central Okanagan Building Bylaw, B.C. Building and Plumbing Code.

2. Failure to obtain a Building Permit for buildings/structures constructed without approval.

The process of placing a Bylaw Contravention Notice on Title has been effective.
Prospective purchasers are made aware of potential problems. As a result, the Bylaw Contravention is occasionally removed or a new Building Permit is obtained to correct deficiencies and to remove the Bylaw Contravention Notice.

Construction slowdown reflected in numbers
Kelowna Capital News - February 12, 2010

Statistics confirm talk that the sputtering economy caused building activity to slow in West Kelowna last year.

Figures from the Central Okanagan Regional District show that construction got underway on 234 houses in the District of West Kelowna in 2009 compared to 275 in 2008.

In 2009, 410 building permits were issued in the municipality compared to 524 in 2008.

The value of all construction in West Kelowna was $51.4 million last year compared to $91.5 million in 2008.

Central Okanagan-wide stats show an even greater slowdown, where housing starts totaled 887 in 2009 compared to 2,024 in 2008, in Kelowna, West Kelowna, Lake Country, Peachland and the Central Okanagan rural electoral areas combined.

Across the region, 2,674 building permits with a construction value of $636.8 million were issued in 2009 compared to 3,179 with a construction value of $710 million the year before.

Recommendation:
That the Regional District Board direct that a notice be filed on the tile of Lot 9, Plan 20608, O.D.Y.D., pursuant to Section 57 of the Community Charter Act, and pursuant to that section of the Community Charter Act, further information regarding the notice be limited to the fact that:

1. The construction of a residential addition, built under authority of Building Permit #1890/04, has not been finalized, which is a violation of Regional District of Central Okanagan Building Bylaw #835.

Background:
On October 27,2004, Building Permit #1890/04 was issued authorizing the construction of a residential addition built prior to issuance of building permit. To date, the project has not received final approval from this office. The following attempts have been made to have the permit finalized:

1. Various letters were forwarded to the owner on November 14, 2005, February 6 and May 10,2006, May 28 and October 29,2007, February 14, June 24 and September 15, 2008.

As requested by the owner two extensions were given.

The owner has been notified of the date, time and location of the meeting which will deal with this report.

Please be advised that the attached report has been prepared for the Regional District of Central Okanagan Board of Directors. If this recommendation is accepted, a notice will be filed on the property title in the Land Title Office, stating that:

a) A resolution relating to that land has been made under Section 57 of the Community Charter Act.
b) Further information respecting it may be inspected at the office of the Regional District of Central Okanagan.

Please note that the information relating to the notice will be restricted to the facts outlined in the accompanying report.

Be advised also that once a title notice is formally registered on the title of the property, a new permit will be required in order to complete the work, have it inspected and the title notice subsequently removed.

The report will be dealt with at the May 25,2009 meeting of the Regional District of Central Okanagan Board of Directors, to be held at the Regional District of Central Okanagan Office at 1450 K.L.O. Road, Kelowna, B.C., at 7:00 p.m.

The question was raised why staff wait so long before coming forward with a recommendation to place a Notice on Title, for example in the above building violation it has been outstanding for three years? The concern is that the owner may sell their property in the meantime without the buyer knowing there are outstanding building permit issues with the property. Staff noted that they try to cooperate with residents who are making progress on outstanding building violations and that in some cases it can take a few years to complete.

SHEPHERD/FINDLATER
THAT staff be directed to develop a Building Violation Policy to include timelines for completion and notices to the Board and report back to the Governance and Services Committee.
